After a Moreno Valley Car Crash: California Scene Duties, Seat Belts and Fault

California law sets out what every driver in an injury crash must do before leaving the scene, and those duties sit alongside the seat belt statute, the comparative fault rule and the two-year filing period. Each is summarized below for crashes in Moreno Valley.

What the Law Requires at the Scene

Vehicle Code § 20001(a) requires a driver involved in a crash that injures or kills another person to stop immediately and fulfill §§ 20003 and 20004. Under § 20003, the driver gives name and current residence address, the names and addresses of injured occupants, the registration number and the owner’s name and address to the person struck, other drivers or occupants and any officer present, shows a license on request and renders reasonable assistance, including arranging transport for medical treatment. If someone was killed and no officer was at the scene, § 20004 requires the driver to report the crash without delay to the nearest California Highway Patrol office or authorized police authority.

Seat Belts

Vehicle Code § 27315(d) bars operating a passenger vehicle, motortruck or truck tractor on a highway unless the operator and all passengers 16 or older are properly restrained by a safety belt, and subsection (e) requires each passenger 16 or older to be restrained. The section has listed exemptions, and it does not apply to motorcycles.

Comparative Fault

Li v. Yellow Cab Co. (1975) adopted pure comparative negligence in California. For example, imagine $100,000 in damages and 40 percent of the fault on the injured driver: the recovery would be $60,000.

Filing Period

Code of Civil Procedure § 335.1 requires an action for injury to, or the death of, an individual caused by another’s wrongful act or neglect to be brought within two years.

Moreno Valley Car Accident Questions

Can I use my own coverage if the other driver fled?

Yes, on two conditions. Insurance Code § 11580.2 allows an uninsured motorist claim when the owner or operator is unknown only if the bodily injury arose from physical contact with that vehicle and the crash was reported within 24 hours to the city police, or to the sheriff or California Highway Patrol in unincorporated territory, with a statement under oath filed with the insurer within 30 days after that.

If two drivers caused my injuries, does each pay all of my pain and suffering?

No. Civil Code § 1431.2 makes each defendant’s liability for noneconomic damages several only, in direct proportion to that defendant’s percentage of fault, with a separate judgment against each defendant for its share.

What deadline applies if a public agency’s vehicle was involved?

Government Code § 911.2 requires the claim within six months after accrual; § 945.6 then allows six months after a written rejection notice to sue, or two years from accrual without one.
