Reports, Insurance Status and Fault in Huntington Beach Car Crash Claims

After a Huntington Beach crash, two reports can be due on short clocks, and whether each driver carried insurance can change what that driver may recover in court.

The DMV Report

Vehicle Code § 16000(a) requires the driver of a motor vehicle involved in a crash on a street or highway that causes more than $1,000 in property damage to any one person, or bodily injury, or death, to report it to the DMV within 10 days, personally or through an insurance agent, broker or legal representative, naming any person complaining of injury. Under subdivision (b), no report is required when the vehicle was owned or leased by, or under the direction of, the United States, California, another state or a local agency.

A Fatal Crash with No Officer at the Scene

Vehicle Code § 20004 requires a driver involved in a crash resulting in death, if no traffic or police officer is at the scene, to report it without delay to the nearest California Highway Patrol office or police authority, with the information § 20003 requires.

Insurance Status and Noneconomic Losses

Civil Code § 3333.4(a) bars noneconomic losses in a motor vehicle case for an injured person convicted of DUI for that crash, an injured owner whose vehicle was not insured as required, and an injured operator who cannot establish financial responsibility. Under subdivision (c), an uninsured owner injured by a motorist convicted of DUI for that crash is not barred.

Shared Fault

Li v. Yellow Cab Co. (1975) adopted pure comparative negligence. For example, imagine $100,000 in damages and 60 percent of the fault on the injured driver: the recovery would be $40,000.

Huntington Beach Car Accident Questions

How long do I have to sue?

Two years under Code of Civil Procedure § 335.1 for injury or death caused by another’s wrongful act or neglect. A claim against a public entity must first be presented within six months after accrual under Government Code § 911.2.

What liability limits does the other driver’s policy have to carry?

For a policy issued or renewed on or after January 1, 2025, Vehicle Code § 16056(a)(2) sets at least $30,000 for one person, $60,000 for two or more people and $15,000 for property damage; earlier policies carried $15,000, $30,000 and $5,000.

Is there a speed rule apart from posted limits?

Yes. Vehicle Code § 22350 bars driving faster than is reasonable or prudent given weather, visibility, traffic and the surface and width of the highway, and in no event at a speed that endangers persons or property.
