California Driving Standards and Recovery Limits for Fontana Car Crashes

For a Fontana crash on a busy corridor, California’s reasonableness standards for speed and following distance set the yardstick for each driver’s conduct. A separate statute limits what a driver convicted of DUI, or driving uninsured, can recover.

Speed and Spacing

Vehicle Code § 22350 bars driving on a highway faster than is reasonable or prudent given the weather, visibility, traffic and the surface and width of the road, and in no event at a speed that endangers persons or property. Vehicle Code § 21703 bars following another vehicle more closely than is reasonable and prudent, having due regard for speed, traffic and roadway condition. Neither statute sets a fixed number.

Limits on Recovery for Certain Drivers

Civil Code § 3333.4 bars noneconomic losses in a motor vehicle case for an injured person convicted of DUI for that crash, an injured owner whose vehicle was not insured as required, or an operator who cannot establish financial responsibility. An uninsured owner injured by a motorist convicted of DUI for that crash keeps the right to recover noneconomic losses.

Proportionate Fault

Li v. Yellow Cab Co. (1975) adopted pure comparative negligence. For example, imagine $100,000 in damages and 40 percent of the fault on the injured driver: the recovery would be $60,000.

Claims Against Public Entities

Government Code § 911.2 requires a claim for death or injury against a public entity to be presented within six months after accrual, and § 945.6 sets the time to sue at six months after a written rejection notice, or two years from accrual without one.
