California’s Duty of Care, Following Distance and Insurance Rules for Oceanside Crashes

California’s negligence law starts from a single statutory duty of ordinary care, and its traffic statutes give that duty concrete form on the road. For an Oceanside rear-end or chain-reaction crash, the following-distance rule and the insurance limits can decide where the claim goes.

The Statutory Duty of Ordinary Care

Civil Code § 1714(a) makes everyone responsible not only for willful acts but also for injury caused to another by a want of ordinary care or skill in managing property or person, except to the extent the injured person brought the injury on willfully or by a want of ordinary care.

Following Too Closely

Vehicle Code § 21703 bars the driver of a motor vehicle from following another vehicle more closely than is reasonable and prudent, having due regard for the speed of the vehicles and the traffic on, and condition of, the roadway. The statute sets no fixed distance; the standard is what is reasonable and prudent under those conditions.

Shared Fault

Under Li v. Yellow Cab Co. (1975), liability is assessed in direct proportion to fault even when the injured person is equally or more at fault. For example, imagine $200,000 in damages and 60 percent of the fault on the injured driver: the recovery would be $80,000.

Policy Limits

Vehicle Code § 16056(a)(2) requires a policy or bond issued or renewed on or after January 1, 2025 to carry at least $30,000 for bodily injury or death of one person, $60,000 for two or more people and $15,000 for property damage to be effective as proof of financial responsibility.

Oceanside Car Accident Questions

Is the deadline different for a claim against the City of Oceanside?

Yes. Government Code § 911.2 requires a claim for injury or death against a public entity to be presented within six months after accrual, and § 945.6 sets the time to sue at six months after a written rejection notice, or two years from accrual without one. Against a private driver, Code of Civil Procedure § 335.1 allows two years.

Who may bring a wrongful death claim in California?

Code of Civil Procedure § 377.60 lets the surviving spouse, domestic partner, children and issue of deceased children assert the claim, or, if there are no surviving issue, those who would inherit by intestate succession; dependent parents, stepchildren and a putative spouse may also qualify, and a minor who lived in the household for the prior 180 days and depended on the deceased for at least half of their support may as well.

When must a crash be reported to the DMV?

Under Vehicle Code § 16000(a), within 10 days, when a crash on a street or highway causes more than $1,000 in property damage to any one person, or any injury or death.
