Hit-and-Run Rules, Helmets and Bike Setup in Oxnard Motorcycle Crashes
When the driver who hit an Oxnard rider does not stop, two statutes apply: one sets the criminal penalty for leaving, and the other decides whether the rider’s own uninsured motorist coverage pays. The rider’s helmet and bike setup are measured under separate sections.
Leaving the Scene
Vehicle Code § 20001 requires a driver involved in a crash that injures or kills another person to stop and fulfill § 20003 and § 20004. Under § 20001(b)(2), when the crash results in death or permanent, serious injury, a violation is punishable by two, three or four years in state prison, 90 days to one year in county jail, a fine of $1,000 to $10,000, or both.
Coverage When the Driver Is Unknown
Insurance Code § 11580.2 covers bodily injury caused by an unknown owner or operator only if the injury arose out of physical contact with the insured or the vehicle the insured was occupying, the crash was reported within 24 hours to the city police department (or, in unincorporated territory, the county sheriff or the local California Highway Patrol headquarters), and a sworn statement was filed with the insurer within 30 days.
Helmets
Vehicle Code § 27803 requires the driver and any passenger on a motorcycle operated on the highways to wear a safety helmet meeting § 27802, fastened with its straps and fitting securely.
Seat and Handlebar Position
Vehicle Code § 27801 bars driving a two-wheel motorcycle with a seat positioned so the driver sitting astride cannot reach the ground with their feet, or with handlebars that put the hands more than six inches above shoulder height.
Oxnard Motorcycle Accident Questions
Can I recover if I was partly at fault?
Yes. Li v. Yellow Cab Co. (1975) adopted pure comparative negligence. For example, imagine $100,000 in damages and 30 percent of the fault on the rider: the recovery would be $70,000.
How does the Vehicle Code define lane splitting?
Vehicle Code § 21658.1 defines it as driving a two-wheeled motorcycle between rows of stopped or moving vehicles in the same lane, on divided and undivided streets, roads or highways, and allows the California Highway Patrol to develop educational guidelines.
How long do I have to sue?
Two years under Code of Civil Procedure § 335.1 for injury or death caused by another’s wrongful act or neglect. A claim against the City of Oxnard or another public entity must first be presented within six months after accrual under Government Code § 911.2.
