Coverage Limits, Shared Fault and Fatal Crash Claims for Denver Motorcycle Riders

For a Denver rider, the insurance picture starts with the other driver’s minimum limits and the rider’s own uninsured motorist coverage. Colorado’s allocation rules then divide fault, including fault of people not in the lawsuit, and a separate statute governs claims when a rider dies.

The Other Driver’s Minimum Limits

C.R.S. 10-4-620 sets the basic required coverage at $25,000 for bodily injury or death to one person, $50,000 to all persons in one accident and $15,000 for property damage.

The Rider’s Uninsured Motorist Coverage

C.R.S. 10-4-609(1)(a) requires motor vehicle liability policies issued in Colorado to include uninsured motorist coverage at the limits of 42-7-103(2), unless the named insured rejects it in writing. A transportation network company covering its drivers may not reject it for periods when a driver is engaged in a prearranged ride.

Fault Shared With Others

Except as provided in subsection (4), C.R.S. 13-21-111.5(1) limits each defendant to its own percentage of fault. Under (3), the finder of fact may assign fault to a nonparty if the claimant settled with that person or a defendant gives notice within 90 days after the action begins, unless the court allows longer.

Who May Sue When a Rider Dies

C.R.S. 13-21-202 allows a wrongful death action whenever the rider could have sued had death not followed. Under 13-21-201(1)(a), in the first year the spouse may sue; on the spouse’s written election, the spouse and heirs or the heirs alone; if there is no spouse, the heirs or a designated beneficiary; and in listed cases, siblings.

Denver Motorcycle Accident Questions

Can I recover if I was partly at fault?

Yes, if your negligence was not as great as the other driver’s under C.R.S. 13-21-111(1). For example, imagine $100,000 in damages and 30 percent of the fault on the rider: the recovery would be $70,000.

Does the helmet law apply to me as an adult?

No, not under 42-4-1502(4.5): its helmet requirement applies to each person under 18 driving or riding on a motorcycle on a roadway.

How long do I have to sue, and what if a city vehicle hit me?

Three years after the cause of action accrues under C.R.S. 13-80-101(1)(n). Against a Denver city agency or another public entity, written notice is due within 182 days after discovery of the injury under 24-10-109(1), and 24-10-114(1) sets base recovery limits of $350,000 for one person and $990,000 for two or more, adjusted every four years; the secretary of state’s certificate puts the adjusted limits at $505,000 and $1,421,000 for claims accruing on or after January 1, 2026 and before January 1, 2030.
