Alabama Rules at the Scene and in Court After a Huntsville Car Crash
What happens in the first minutes after a Huntsville crash and how fault is judged later are both governed by Alabama statutes and by one long-standing court decision. The rules below follow that order.
Stopping, Moving the Vehicle and Helping the Injured
Ala. Code § 32-10-1 requires a driver in a crash that causes injury, death or damage to an attended vehicle to stop and stay at or near the scene until the duties in § 32-10-2 are met. A vehicle in a crash with injury or death may not be moved until a law enforcement officer directs it, while a drivable vehicle in a crash with no apparent injury may be moved to the shoulder or another nearby location by a driver who is not impaired. Section 32-10-2 requires giving name, address and registration number, showing a license on request and giving reasonable assistance to anyone injured.
Proof of Insurance in the Vehicle
Ala. Code § 32-7A-6(a) requires the operator of a covered vehicle to carry evidence that it is covered by an Alabama liability policy, such as an insurance card, a current declarations page, a binder or certificate of insurance, or a current rental agreement specifying coverage.
Seat Belts
Under Ala. Code § 32-5B-4(a), each occupant of a passenger car equipped with federally compliant safety belts must wear one whenever the vehicle is moving, and a violation in a seat other than a front seat is a secondary violation that can be charged only after a lawful stop for another violation. The section exempts, among others, child passengers covered by the child restraint law, occupants with a physician’s written medical statement, and passengers in cars made before 1965.
Fault and the Filing Deadline
The Alabama Supreme Court declined to replace contributory negligence with comparative negligence in Golden v. McCurry (1980). Ala. Code § 6-2-38(l) gives two years to bring an action for injury to the person not arising from contract and not listed elsewhere in the section.

How soon must a claim against the City of Huntsville be presented?
Ala. Code § 11-47-23 requires claims against a municipality for damages growing out of torts to be presented within six months from accrual, or they are barred.
What does Alabama law require of a driver at a stop sign?
Ala. Code § 32-5A-112(b) requires a driver at a stop sign to stop and then yield to any vehicle in the intersection or approaching closely enough to be an immediate hazard. For yield signs, subsection (c) makes a collision after driving past the sign without stopping prima facie evidence of failure to yield.
How long does a family have to file after a fatal crash?
A wrongful death action brought by the personal representative must be commenced within two years after the death, under Ala. Code § 6-5-410(d) and § 6-2-38(a).
