State and City Claims, Pain and Suffering Arguments and Wrongful Death Recovery for Atlanta Car Crashes

An Atlanta car crash claim against the State or the City follows separate written notice rules with different deadlines. Georgia law also limits when counsel may argue a dollar figure for pain and suffering and decides who recovers the full value of the life of a person killed in a crash.

Claims Against the State

Under O.C.G.A. 50-21-26(a), no action may be brought on a tort claim against the State without first giving written notice within 12 months of the date the loss was discovered or should have been discovered, mailed by certified mail or statutory overnight delivery, return receipt requested, or delivered personally to the Risk Management Division of the Department of Administrative Services, with a copy to the state government entity involved.

Claims Against the City

Under O.C.G.A. 36-33-5(b) and (e), a claim against a municipal corporation must be presented in writing to its governing authority within six months of the event, stating the time, place and extent of the injury, the negligence that caused it and the specific amount sought. Under (c) and (d), the governing authority acts within 30 days, and the statute of limitations is suspended while the claim is pending without action.

Arguing a Value for Pain and Suffering

Under O.C.G.A. 9-10-184, as rewritten by SB 68 in 2025, counsel may argue the worth or monetary value of noneconomic damages only after the close of evidence, at the party’s first opportunity to argue damages, and the argument must be rationally related to the evidence; a party with the opening and concluding arguments may not argue a different value in closing than in opening.

When a Crash Is Fatal

Under O.C.G.A. 51-4-2(a), the surviving spouse or, if there is none, the child or children may recover the full value of the life of the decedent, as shown by the evidence. Under (d), the recovery is divided equally among the spouse and children, with the spouse receiving at least one-third, and under (e) it is not subject to any debt of the decedent or the estate.

Atlanta Car Accident Questions

How long do I have to sue the other driver?

Two years after the right of action accrues for injuries to the person under O.C.G.A. 9-3-33, and four years for a loss of consortium claim, except as otherwise provided in that article.

Can I recover if I was partly at fault?

Yes, if you were less than 50 percent responsible. Under O.C.G.A. 51-12-33(a) and (g), damages are reduced by your percentage of fault, and a plaintiff 50 percent or more responsible recovers nothing. For example, imagine $52,000 in damages and 25 percent of the responsibility on the injured driver: the recovery would be $39,000.

Does my policy include uninsured motorist coverage?

Yes, unless rejected in writing. Under O.C.G.A. 33-7-11(a)(1), a motor vehicle liability policy issued in Georgia must include uninsured motorist coverage, but the requirement does not apply where any insured named in the policy rejects the coverage in writing.
