Government Notice Deadlines, Liability Limits and Wrongful Death Actions for Fort Wayne Car Crashes
A Fort Wayne car crash with a city, county or state vehicle runs on Indiana’s tort claim notice deadlines, 180 days for a political subdivision and 270 days for the state, and on the limits of government liability. Indiana also sets the two-year wrongful death action and who receives its damages.
Notice to a City or County
Under IC 34-13-3-8(a), except as provided in section 9, a claim against a political subdivision is barred unless notice is filed with its governing body, and with the Indiana political subdivision risk management commission if the subdivision was a member of the fund, within 180 days after the loss occurs.
Notice to the State
Under IC 34-13-3-6(a), except as provided in sections 7 and 9, a claim against the state is barred unless notice is filed with the attorney general or the state agency involved within 270 days after the loss; filing with the wrong agency does not bar a claim if the claimant reasonably tried to find the right one.
Limits on Government Liability
Under IC 34-13-3-4, the combined liability of all governmental entities and employees acting within the scope of employment may not exceed $700,000 for injury to or death of one person in an occurrence, for causes accruing on or after January 1, 2008, and $5,000,000 for all persons in that occurrence, and no punitive damages are allowed.
A Wrongful Death Action
Under IC 34-23-1-1, the personal representative must commence the action within two years, and the damages include reasonable medical, hospital, funeral and burial expenses and the decedent’s lost earnings; the expense portion goes to the estate, and the remainder to the widow or widower and dependent children or dependent next of kin.
Fort Wayne Car Accident Questions
How long do I have to sue after a Fort Wayne car crash?
Two years under IC 34-11-2-4(a) for an injury claim, and two years under 34-23-1-1 for a wrongful death action, with the government notice deadlines running first.
What if more than one driver caused the crash?
You are barred under IC 34-51-2-6(b) only if your fault is greater than the fault of all persons whose fault contributed. For example, imagine $150,000 in damages, 40 percent of the fault on the injured driver and 30 percent on each of two other drivers: the combined 60 percent exceeds your 40 percent, so under 34-51-2-5 the recovery would be $90,000.
Can punitive damages be awarded against a city?
No. Under IC 34-13-3-4(b), a governmental entity or an employee acting within the scope of employment is not liable for punitive damages.
