Scene and Notice Duties, PIP Timing and Exemplary Damages for Grand Prairie Car Crashes
After a Grand Prairie car crash, Texas law sets what each driver must do at the scene and whom to notify, including for a collision just outside city limits. The injured person’s own personal injury protection has payment deadlines, and exemplary damages follow a separate standard of proof and cap.
Duties at the Scene
Under Texas Transportation Code 550.021(a), the operator of a vehicle in a collision that results or is reasonably likely to result in injury or death must immediately stop, return if not stopped at the scene, determine whether anyone needs aid and remain until the 550.023 duties are met. Section 550.023 requires giving name, address, registration number and liability insurer, showing a driver’s license on request and providing reasonable assistance, including transport for treatment when it is apparently necessary or requested.
Notice Near the City Line
Under Section 550.026(a), a collision causing injury, death or damage that leaves a vehicle unable to be normally and safely driven must be reported immediately: to the local police department if it occurred in a municipality, to the local police department or the sheriff’s office if it occurred not more than 100 feet outside the limits of a municipality, and otherwise to the sheriff’s office or the nearest office of the department.
When PIP Is Paid
Under Texas Insurance Code 1952.156, personal injury protection benefits are paid as claims arise and no later than the 30th day after the insurer receives satisfactory proof of a claim, and the policy may require the original proof of loss within a period of not less than six months after the accident.
Exemplary Damages
Under Texas Civil Practice and Remedies Code 41.003, exemplary damages require clear and convincing proof of fraud, malice or gross negligence and a unanimous jury. Section 41.008(b) caps them at the greater of two times economic damages plus noneconomic damages found by the jury up to $750,000, or $200,000, with the exceptions listed in 41.008(c).
Grand Prairie Car Accident Questions
Can I recover if I was partly at fault?
Yes, unless your percentage of responsibility is greater than 50 percent under Section 33.001. For example, imagine $100,000 in damages and 20 percent of the responsibility on the injured driver: the recovery would be $80,000.
How long do I have to sue?
Two years after the day the cause of action accrues under Section 16.003(a) for personal injury, and two years after the death under 16.003(b) for wrongful death.
What if a city vehicle hit me?
Under Section 101.101, the city is entitled to notice of the claim within six months after the incident, or within a charter period the statute ratifies, unless it has actual notice of the injury; under 101.023(c), a municipality’s liability is limited to $250,000 per person and $500,000 per occurrence for bodily injury or death.
