PIP, Uninsured Motorist Coverage and Insurance Minimums for Fort Worth Car Crashes

After a Fort Worth car crash, the Texas Insurance Code decides what the injured person’s own policy pays before fault is settled and whether it covers a driver with no insurance. The Transportation Code sets the liability minimums every driver must meet, and a separate rule protects claims of injured children.

What Personal Injury Protection Pays

Under Texas Insurance Code 1952.151, personal injury protection pays the named insured, household members and any authorized operator or passenger, including a guest occupant, for reasonable expenses that arise from the accident and are incurred within three years: necessary medical, hospital and funeral services, lost income for an income producer, and essential household services for a person who was not earning income.

When PIP and Uninsured Motorist Coverage Apply

Under Sections 1952.152 and 1952.101, an automobile liability policy must include personal injury protection and uninsured or underinsured motorist coverage unless any insured named in the policy rejects that coverage in writing. Under 1952.156, PIP benefits are paid as claims arise and no later than the 30th day after the insurer receives satisfactory proof, and the policy may require the original proof of loss within a period of not less than six months.

Liability Minimums

Texas Transportation Code 601.072(a-1) sets minimum liability coverage of $30,000 for bodily injury to or death of one person, $60,000 for two or more persons in one collision, and $25,000 for damage to the property of others.

Injured Children and the Deadline

Under Texas Civil Practice and Remedies Code 16.001, a person younger than 18 is under a legal disability, and if the disability exists when the cause of action accrues, that time is not counted in the limitations period. A disability that arises after the period starts does not suspend it.

Fort Worth Car Accident Questions

Can I recover if I was partly at fault?

Yes, unless your percentage of responsibility is greater than 50 percent under Texas Civil Practice and Remedies Code 33.001; Section 33.012(a) reduces the damages by your percentage. For example, imagine $120,000 in damages and 25 percent of the responsibility on the injured driver: the recovery would be $90,000.

How long do I have to sue?

Two years after the day the cause of action accrues for personal injury under Section 16.003(a), and two years after the death for a wrongful death action under 16.003(b). A crash with a City of Fort Worth vehicle adds a shorter step: under Section 101.101, the city is entitled to notice within six months after the incident unless it had actual notice of the injury, and a charter notice period ratified under 101.101(b) can apply instead, so check the charter period early.

Who must be notified after a crash inside Fort Worth?

The local police department. Under Texas Transportation Code 550.026(a), the driver in a collision causing injury, death or damage that leaves a vehicle unable to be normally and safely driven must immediately notify the local police department when the collision occurs in a municipality.
