Crash Reports, Medical Coverage, Responsible Third Parties and Uninsured Drivers for Lubbock Car Crashes

A Lubbock car crash claim starts with the report Texas requires after an injury crash and the personal injury protection that may pay medical bills before fault is settled. Texas law then decides how responsibility is divided among everyone involved and whether the injured driver’s own policy covers an uninsured driver.

Reporting the Crash

Under Texas Transportation Code 550.026(a), the operator of a vehicle in a collision resulting in injury or death, or in damage that leaves a vehicle unable to be normally and safely driven, must immediately give notice by the quickest means of communication to the local police department when the collision occurs in a municipality such as Lubbock.

Personal Injury Protection

Under Texas Insurance Code 1952.152, an automobile liability policy includes personal injury protection unless any named insured rejects it in writing, and under 1952.151 the coverage pays reasonable expenses arising from the accident and incurred within three years from the date of the accident.

Responsible Third Parties

Under Texas Civil Practice and Remedies Code 33.003(a), the trier of fact assigns a whole-number percentage of responsibility to each claimant, defendant, settling person and responsible third party designated under 33.004, and under 33.013 a defendant more than 50 percent responsible is also jointly and severally liable for the claimant’s recoverable damages.

Uninsured Motorist Coverage

Under Texas Insurance Code 1952.101, an automobile liability policy must include uninsured or underinsured motorist coverage, in at least the limits prescribed by Chapter 601 of the Transportation Code, unless any insured named in the policy rejects it in writing.

Lubbock Car Accident Questions

Can I recover if I was partly at fault?

Yes, unless your percentage of responsibility is greater than 50 percent under Section 33.001. For example, imagine $100,000 in damages and 25 percent of the responsibility on the injured driver: the recovery would be $75,000.

How long do I have to sue?

Two years after the day the cause of action accrues under Section 16.003(a) for personal injury, and two years after the death under 16.003(b) for wrongful death.

What if a state vehicle or state equipment was involved?

Under Section 101.021, a governmental unit is liable for injury from an employee’s operation or use of a motor-driven vehicle or motor-driven equipment when the employee would be personally liable; the unit is entitled to notice within six months under 101.101, and the state’s liability is limited to $250,000 per person and $500,000 per occurrence under 101.023(a). Emergency driving is treated differently: under 101.055(2), a claim arising from an employee’s response to an emergency call or emergency situation falls outside the chapter when the action complied with the applicable emergency laws or, without such a law, was not taken with conscious indifference or reckless disregard for others’ safety.
