Noneconomic Damages Caps, Local Government Claims and Required Coverage for Baltimore Car Crashes

A Baltimore car crash claim in Maryland faces a statutory cap on noneconomic damages that rises each October 1, and a claim against Baltimore City needs written notice to the City Solicitor within one year. Maryland also sets the liability security and personal injury protection every vehicle must carry.

The Noneconomic Damages Cap

Under Md. Code, Courts and Judicial Proceedings § 11-108(b)(2), noneconomic damages for personal injury or wrongful death in causes arising on or after October 1, 1994 may not exceed $500,000, increased by $15,000 each October 1 beginning in 1995, with each increase applying to causes arising from October 1 through the following September 30. For causes arising from October 1, 2026 through September 30, 2027, that works out to $980,000, and under (d) the jury is not told about the cap.

A Claim Against Baltimore City

Under Courts and Judicial Proceedings § 5-304(b) and (c), an action for unliquidated damages against a local government or its employees requires written notice of the time, place and cause of the injury within one year after the injury, given in person or by certified mail, and for Baltimore City the notice goes to the City Solicitor. Under § 5-303(a)(1), a local government’s liability may not exceed $400,000 per individual claim and $800,000 per occurrence.

Required Security

Under Md. Code, Transportation § 17-103(b), required vehicle security must provide at least $30,000 for bodily injury to or death of one person, $60,000 for two or more persons and $15,000 for property damage, along with personal injury protection unless waived.

Contributory Negligence

Maryland applies contributory negligence: in Coleman v. Soccer Ass’n of Columbia (2013), the Court of Appeals of Maryland declined to abrogate the doctrine, and because the jury found the plaintiff contributorily negligent, he was barred from any recovery. A Baltimore driver who shares any fault for a crash should expect the other side to raise it.

Personal Injury Protection

Under Md. Code, Insurance § 19-505, personal injury protection provides at least $2,500 for medical and related expenses incurred within three years, 85 percent of lost income and essential services, covering the named insured and household members, permissive users, guests and pedestrians, subject to waiver under § 19-506.

Baltimore Car Accident Questions

How long do I have to sue after a Baltimore car crash?

Three years from the date the claim accrues, under Courts and Judicial Proceedings § 5-101, unless another provision sets a different period, and notice to the City Solicitor within one year for a claim against Baltimore City under § 5-304.

Is there a cap on pain and suffering in Maryland?

Yes. Under Courts and Judicial Proceedings § 11-108, the cap for a cause of action arising from October 1, 2026 through September 30, 2027 is $500,000 plus 32 annual increases of $15,000, or $980,000, and a jury award above the cap is reduced by the court.

Is leaving an injury crash a crime in Maryland?

Yes. Under Transportation § 20-102, a driver in a crash causing bodily injury or death must stop, return and remain until complying with § 20-104, and failing to do so carries criminal penalties that increase with the severity of the injury and whether the driver knew or should have known of it.
