Helmet Stops, Hit-and-Run Penalties and Death Claims for Lubbock Motorcycle Crashes
A Lubbock motorcycle crash claim can raise how the Texas helmet exception works when an officer stops a rider, what happens to a driver who leaves the scene, and who brings the claim when a rider dies. The rider’s own policy may also cover a driver with no insurance.
Helmet Stops and Proof
Under Texas Transportation Code 661.003(c), the headgear rule does not apply to a person at least 21 who has completed a Chapter 662 motorcycle operator training and safety course or is covered by a health insurance plan with medical benefits for motorcycle collision injuries. Under (c-1), a peace officer may not stop or detain a rider or passenger solely to check the course or the plan, and under (c-2) the Texas Department of Insurance prescribes a standard proof of health insurance.
A Driver Who Leaves
Under Section 550.021(a), the driver of a vehicle in a collision that results or is reasonably likely to result in injury or death must stop, return if not stopped at the scene, determine whether anyone needs aid and remain until the 550.023 duties are met. Under 550.021(c), failing to do so is a second-degree felony when the collision causes death, a third-degree felony when it causes serious bodily injury, and otherwise punishable by up to five years in prison or one year in county jail, a fine up to $5,000, or both.
A Fatal Crash
Under Texas Civil Practice and Remedies Code 71.002(b), a person is liable for damages from an injury that causes death if it was caused by that person’s or that person’s agent’s or servant’s wrongful act, neglect, carelessness, unskillfulness or default. Under 71.004, the action is for the exclusive benefit of the surviving spouse, children and parents, any of whom may bring it for all.
Uninsured Motorist Coverage
Under Texas Insurance Code 1952.101, uninsured or underinsured motorist coverage protects insureds legally entitled to recover from owners or operators of uninsured or underinsured motor vehicles for bodily injury, death or property damage, and an automobile liability policy must include it unless any insured named in the policy rejects it in writing.
Lubbock Motorcycle Accident Questions
Can I recover if I was partly at fault?
Yes, unless your percentage of responsibility is greater than 50 percent under Section 33.001. For example, imagine $200,000 in damages and 35 percent of the responsibility on the rider: the recovery would be $130,000.
How long do I have to sue?
Two years after the day the cause of action accrues under Section 16.003(a) for personal injury, and two years after the death under 16.003(b) for wrongful death.
What if a City of Lubbock vehicle hit me?
Under Section 101.023(c), a municipality’s liability is limited to $250,000 per person and $500,000 per occurrence for bodily injury or death, and under 101.101 the city is entitled to notice within six months after the incident unless a ratified charter period or actual notice applies.
