Municipal Notice, Damage Limits and Wrongful Death Actions for St. Paul Car Crashes
A St. Paul car crash with a city vehicle requires a notice of claim to the governing body within 180 days, and Minnesota limits what a municipality pays. Minnesota also sets the trustee, deadline and damages for a wrongful death action and a clear and convincing evidence standard for punitive damages.
The 180-Day Notice of Claim
Under Minn. Stat. 466.05 subd. 1, a person claiming damages from a municipality or a municipal employee acting within the scope of employment must present notice to the governing body within 180 days after the loss or injury is discovered, stating the time, place and circumstances, the employees known to be involved and the relief demanded. Actual notice of sufficient facts can satisfy the requirement, and under subd. 2 a wrongful death notice may be presented within one year.
Limits on a Municipality’s Liability
Under Minn. Stat. 466.04 subd. 1, for claims arising on or after July 1, 2009, a municipality’s liability may not exceed $500,000 to any claimant or for a wrongful death claim, and $1,500,000 for all claims from a single occurrence, and no punitive damages are allowed.
A Wrongful Death Action
Under Minn. Stat. 573.02 subd. 1, a court-appointed trustee may bring the action if the decedent could have sued, within three years after the death and no later than six years after the act or omission, and the recovery covers the decedent’s damages before death and the pecuniary loss from the death, for the surviving spouse and next of kin in proportion to their loss, after funeral expenses are deducted.
Punitive Damages
Under Minn. Stat. 549.20 subd. 1, punitive damages are allowed only on clear and convincing evidence that the defendant acted with deliberate disregard for the rights or safety of others.
St. Paul Car Accident Questions
How long do I have to sue after a St. Paul car crash?
Six years in the general case: in D.M.S. v. Barber (2002), the Minnesota Supreme Court stated that, generally, personal injury actions grounded on negligence must be commenced within the six-year period of Minn. Stat. 541.05, now subd. 1(5), while 541.07(1) sets two years for the torts it lists; confirm with counsel which applies to your claim. A claim against the city also needs the 180-day notice under 466.05.
What if two other drivers share the fault?
Your fault is compared with each driver you are suing under Minn. Stat. 604.01 subd. 1. For example, imagine $100,000 in damages, 30 percent of the fault on the injured driver, 55 percent on one driver and 15 percent on another: the claim against the 15 percent driver is barred, and the recovery would be $70,000, all of it collectible from the 55 percent driver, who is over 50 percent under 604.02 subd. 1.
Do I have to meet the no-fault threshold to recover pain and suffering?
Yes. Under Minn. Stat. 65B.51 subd. 3, noneconomic damages require medical expenses over $4,000, or permanent disfigurement, permanent injury, death, or disability for 60 days or more.
