California Reporting, Hit-and-Run and Coverage Rules for Sacramento Crashes

Sacramento drivers involved in an injury crash face two separate reporting duties under California law, one at the scene and one to the DMV within 10 days. This section also covers the liability limits behind the other driver’s policy and the two-year filing period.

The DMV Report

Vehicle Code § 16000(a) requires a driver involved in a crash on a street or highway that causes more than $1,000 in property damage to any one person, or any bodily injury or death, to report it to the DMV within 10 days on the approved form, either personally or through an insurance agent, broker or legal representative. No report is required under that subdivision for a vehicle owned or leased by the United States, a state or a local agency, and if no party reports within one year, the DMV is not required to file a report.

Leaving the Scene

Vehicle Code § 20001 requires a driver in a crash that injures or kills another person to stop immediately and meet the information and assistance duties of §§ 20003 and 20004. A violation can be punished by imprisonment in state prison or up to one year in county jail, a fine of $1,000 to $10,000, or both; when the crash causes death or permanent, serious injury, the prison term is two, three or four years, or county jail for 90 days to one year.

The Other Driver’s Liability Limits

Vehicle Code § 16056(a)(2) requires a policy or bond issued or renewed on or after January 1, 2025 to carry at least $30,000 per person and $60,000 per accident for bodily injury and $15,000 for property damage to be effective as proof of financial responsibility. Policies issued earlier were measured against $15,000, $30,000 and $5,000, and subdivision (d) adds another increase for policies issued or renewed on or after January 1, 2035.

Two-Year Deadline

Code of Civil Procedure § 335.1 requires an action for injury to, or the death of, an individual caused by another’s wrongful act or neglect to be brought within two years.

Sacramento Car Accident Questions

Can I recover if I was partly to blame?

Yes. Under Li v. Yellow Cab Co. (1975), damages are reduced in proportion to the injured person’s fault rather than barred. For example, imagine $50,000 in damages and 20 percent of the fault on the injured driver: the recovery would be $40,000.

What if a state or city vehicle caused the crash?

Government Code § 911.2 requires a claim for injury or death against a public entity to be presented within six months after accrual, and § 945.6 sets the deadline to sue at six months after a written rejection notice, or two years from accrual without one.

Can driving at the posted limit still be unlawful?

Yes. Vehicle Code § 22350 bars driving at a speed greater than is reasonable or prudent having due regard for weather, visibility, traffic and the surface and width of the highway, and in no event at a speed that endangers persons or property.
