Road Conditions, Bike Setup and Shared Fault in Sacramento Motorcycle Crashes

A Sacramento motorcycle crash can involve a road defect, the setup of the bike, or several drivers at once. California law has a separate rule for each: a liability test for public property, limits on seat and handlebar position, and several liability for noneconomic damages.

A Dangerous Condition of Public Property

Except as provided by statute, Government Code § 835 makes a public entity liable for injury caused by a dangerous condition of its property if the property was dangerous at the time of injury, the condition proximately caused the injury and created a reasonably foreseeable risk of that kind of injury, and either an employee’s negligent or wrongful act created it or the entity had actual or constructive notice in time to protect against it.

The Claim Deadlines

Government Code § 911.2 requires a claim for personal injury to be presented within six months after accrual. Under § 945.6, suit is due within six months after a written rejection notice is personally delivered or mailed, or within two years from accrual if no notice is given.

Seat and Handlebar Position

Vehicle Code § 27801 bars driving a two-wheel motorcycle with a seat positioned so the driver sitting astride cannot reach the ground with their feet, or with handlebars that put the hands more than six inches above shoulder height.

More Than One At-Fault Party

Civil Code § 1431.2(a) makes each defendant liable for noneconomic damages only in direct proportion to that defendant’s percentage of fault, with a separate judgment for that amount.

Sacramento Motorcycle Accident Questions

Can I recover if I was partly at fault?

Yes. Li v. Yellow Cab Co. (1975) adopted pure comparative negligence. For example, imagine $100,000 in damages and 35 percent of the fault on the rider: the recovery would be $65,000.

What if the driver who hit me had no insurance?

The rider’s own uninsured motorist coverage under Insurance Code § 11580.2 can apply, unless the insurer and named insured deleted it or reduced it by written agreement in the statutory form; a reduced amount may not fall below the Vehicle Code § 16056 limits.

How long do I have to sue the other driver?

Two years under Code of Civil Procedure § 335.1 for injury or death caused by another’s wrongful act or neglect.
