Helmet Standards, Scene Duties and Damages Limits for Colorado Springs Motorcycle Claims
A Colorado Springs motorcycle crash claim begins with the rider rules in Colorado’s motorcycle statute and the duties the other driver had after the crash. Colorado’s noneconomic damages limit then shapes what a serious-injury claim can recover.
The Helmet Standard
C.R.S. 42-4-1502(4.5) requires each person under 18 driving or riding on a motorcycle, autocycle or low-power scooter on a roadway to wear a protective helmet designed to reduce injuries from head impacts, conforming to paragraph (b), which references FMVSS 218, and secured with a chin strap while moving. Violating any provision of the section is a class A traffic infraction.
Hands on the Handlebars
C.R.S. 42-4-1502(3) bars operating a motorcycle while carrying packages, bundles or other articles that prevent keeping both hands on the handlebars, and (2) requires riding astride the seat, facing forward, with one leg on either side.
The Other Driver’s Duties
C.R.S. 42-4-1601 requires a driver directly involved in a crash resulting in injury, serious bodily injury or death to stop at or as close to the scene as possible, or return immediately, and to remain until fulfilling the duties of 42-4-1603(1). Leaving is a class 1 misdemeanor traffic offense for injury, a class 4 felony for serious bodily injury and a class 3 felony for death.
The Noneconomic Damages Limit
For a civil action filed in 2025 or a claim that accrues on or after January 1, 2025, other than a health care or wrongful death action, C.R.S. 13-21-102.5(3)(a)(II) caps derivative and direct noneconomic damages at $1,500,000. Actions filed before January 1, 2025 fall under the earlier $250,000 and $500,000 limits of (3)(a)(I).
Colorado Springs Motorcycle Accident Questions
Can I recover if I was partly at fault?
Yes, if your negligence was not as great as the other driver’s under C.R.S. 13-21-111(1). For example, imagine $100,000 in damages and 20 percent of the fault on the rider: the recovery would be $80,000.
How long do I have to sue?
Three years after the cause of action accrues under C.R.S. 13-80-101(1)(n). Under (n)(II), that period does not apply to strict liability, absolute liability or failure-to-warn actions governed by other sections. Against the City of Colorado Springs or another public entity, written notice must be filed within 182 days after discovery of the injury under 24-10-109(1).
Does my policy include uninsured motorist coverage?
Yes, unless the named insured rejected it in writing: C.R.S. 10-4-609(1)(a) requires the coverage on motor vehicle liability policies issued in Colorado.
