Colorado Damages Limits, Exemplary Damages and Scene Duties for Colorado Springs Car Crashes

Noneconomic Damages by Filing Date

Under C.R.S. 13-21-102.5(3)(a), a civil action filed before January 1, 2025, other than one against a health care professional or institution, is limited to $250,000 in noneconomic damages unless the court finds justification by clear and convincing evidence, and never more than $500,000. For an action filed in 2025, or a claim that accrues on or after January 1, 2025, other than a health care or wrongful death action, the limit is $1,500,000 for derivative and direct noneconomic damages.

Exemplary Damages

C.R.S. 13-21-102 allows reasonable exemplary damages when the injury is attended by fraud, malice or willful and wanton conduct, in an amount not exceeding the actual damages awarded.
