The Tort Threshold, Comparative Negligence and Wrongful Death Actions for Honolulu Motorcycle Crashes
A Honolulu motorcycle crash claim in Hawaii can turn on whether the no-fault tort threshold is met, on the rule that a rider recovers only if not more at fault than the defendants together, and on the two-year wrongful death action. Hawaii also treats leaving a serious crash as a class B felony.
The Tort Threshold
Under HRS 431:10C-306(a) and (b), tort liability arising from motor vehicle accidents is abolished for the owner, operator or user of an insured motor vehicle except for death, a significant permanent loss of use of a body part or function, a permanent and serious disfigurement causing mental or emotional suffering, or personal injury protection benefits incurred of $5,000 or more. Confirm with counsel how these rules apply to a claim involving a motorcycle.
Comparative Negligence
Under HRS 663-31(a) through (c), the rider’s contributory negligence does not bar recovery if it was not greater than the negligence of the person, or the aggregate negligence of the persons, against whom recovery is sought; the jury states each party’s percentage, and the court reduces the award in proportion or enters judgment for the defendant if the rider’s share is greater.
A Wrongful Death Action
Under HRS 663-3, the legal representative or listed survivors may recover fair and just compensation for pecuniary injury and loss of love and affection, the legal representative may also recover last illness and burial expenses for the estate, and the action must be commenced within two years from the date of death.
Leaving the Scene
Under HRS 291C-12, a driver in a collision resulting in serious bodily injury or death must stop and remain until the 291C-14 duties are fulfilled; a violation is a class B felony with license revocation and a $500 surcharge.
Honolulu Motorcycle Accident Questions
How long do I have to sue after a Honolulu motorcycle crash?
Two years after the cause of action accrues, under HRS 657-7. Before a county can be liable for injuries on its streets or caused by its employees, HRS 46-72 requires written notice of when, where and how the injuries occurred and the amount claimed, within two years after they accrued.
Can I recover if I was partly at fault?
Yes, if your negligence is not greater than the aggregate negligence of those you are suing. For example, imagine $110,000 in damages and 45 percent of the negligence on the rider: under HRS 663-31 the recovery would be $60,500.
Are other defendants jointly liable in a motorcycle crash case?
Yes, in a motor vehicle accident case. Under HRS 663-10.9(2)(F), joint and several liability for economic and noneconomic damages remains for torts relating to motor vehicle accidents, apart from the highway maintenance and design claims in (4).
