Eye Protection, Wrongful Death Damages and Joint Liability for Chicago Motorcycle Crashes

Eye Protection
Under 625 ILCS 5/11-1404(a), the operator of a motorcycle and every passenger must be protected by glasses, goggles or a transparent shield, and under (c) contact lenses are not acceptable eye protection.
A Wrongful Death Action
Under 740 ILCS 180/2(a) and (b), the personal representative brings the action for the surviving spouse and next of kin, the damages compensate the pecuniary injuries from the death, including grief, sorrow and mental suffering, and the recovery is distributed by the court according to each person’s dependency. The action must be commenced within two years after the death, with longer periods for listed violent intentional conduct.
Joint Liability for Medical Expenses
