Aid at the Scene, Coverage and Death Claims for Orlando Motorcycle Crashes

After an Orlando motorcycle crash, the other driver’s duty to stop and help comes first. Florida law then decides whether the rider’s own policy covers an uninsured driver, and, when a rider dies, which survivors and what estate losses can be recovered.

The Duty to Help

Florida Statutes 316.062(1) requires the driver of a vehicle in a crash resulting in injury or death to give name, address and registration number, to exhibit a driver’s license on request, and to render reasonable assistance to an injured person, including carrying or arranging to carry the person for medical treatment when it is apparent treatment is needed or the injured person asks.

Uninsured Motorist Coverage

Florida Statutes 627.727(1) requires uninsured motorist coverage in a motor vehicle liability policy providing bodily injury coverage, unless the named insured rejects it in writing on behalf of all insureds.

Damages When a Rider Dies

Under Florida Statutes 768.20, the personal representative brings one action for the survivors and the estate. Section 768.21 allows survivors to recover lost support and services and listed relatives to recover lost companionship and mental pain and suffering; medical and funeral expenses go to the survivor who paid them; and the estate may recover lost earnings from injury to death, less lost support of survivors, and in listed situations the prospective net accumulations of the estate.

Eye Protection and Young Riders

Florida Statutes 316.211(2) requires a motorcycle operator to wear an approved eye-protective device, and (6) requires a motorcycle registered to a person under 21 to display a license plate unique in design and color. Under (3)(b), only a person over 21 with at least $10,000 in motorcycle crash medical benefits may ride without headgear. That medical coverage matters because a motorcycle, with fewer than four wheels, is not a “motor vehicle” under the no-fault definition in 627.732(3).

Orlando Motorcycle Accident Questions

Can I recover if I was partly at fault?

Yes, unless your share is greater than 50 percent under Florida Statutes 768.81(6). For example, imagine $200,000 in damages and 20 percent of the fault on the rider: the recovery would be $160,000.

How long do I have to sue?

Two years under Florida Statutes 95.11(5)(a) for an action founded on negligence, and two years under 95.11(5)(e) for wrongful death. A claim against a city, county or state agency also requires a written injury claim within 3 years under 768.28(6)(a).

Can a bar that served the driver be sued?

Yes, but only in listed cases. Florida Statutes 768.125 bars liability for serving a person of lawful drinking age, except for willfully and unlawfully serving someone under the lawful drinking age or knowingly serving a person habitually addicted to alcohol.
