How Arizona Divides Fault and Damages in Mesa Car Accident Cases
In a Mesa crash involving several drivers, Arizona law asks two separate questions: how much of the harm the injured person caused, and how the rest is split among everyone else, including people who are not in the lawsuit.
The Injured Driver’s Share
A.R.S. § 12-2505(A) leaves contributory negligence and assumption of risk to the jury and, when applied, reduces the full damages in proportion to the claimant’s fault instead of barring the action. For example, imagine $100,000 in damages with the injured driver found 25 percent at fault: the damages become $75,000.
Each Defendant Pays Only Its Own Share
Under A.R.S. § 12-2506(A), each defendant’s liability is several, not joint: the jury multiplies the recoverable damages by that defendant’s percentage of fault, and that is the most recoverable from it. Subsection (B) has the jury consider the fault of everyone who contributed to the injury, including a nonparty if the plaintiff settled with that person or a defendant gives notice before trial that the nonparty was at fault. A nonparty’s percentage is used only to measure the named parties’ fault and does not make the nonparty liable, and the fault of the claimant, the defendants and any nonparties is apportioned as a whole at one time.
No Statutory Limit on the Amount
Article 18, Section 6 of the Arizona Constitution provides that the right of action to recover damages for injuries shall never be abrogated and that the amount recovered shall not be subject to any statutory limitation, except that a crime victim is not subject to a claim by a person harmed while committing, attempting or fleeing a felony.
Deadline and Insurance Minimums
A.R.S. § 12-542 sets two years after accrual for an action for injuries to the person. For policies issued or renewed on or after July 1, 2020, A.R.S. § 28-4009 requires at least $25,000 per person, $50,000 per accident for bodily injury and $15,000 for property damage.
Mesa Car Accident Questions
Is the deadline different if a City of Mesa vehicle hit me?
Yes. A.R.S. § 12-821.01 requires a claim against a public entity or public employee to be filed with the person authorized to accept service within 180 days after the cause of action accrues, stating the facts and a specific settlement amount, and § 12-821 requires the lawsuit within one year after accrual.
Does Arizona’s seat belt law apply to back-seat adults?
No. A.R.S. § 28-909(A) requires each front seat occupant to wear the installed lap and shoulder belt or lap belt, and subsection (B) requires the driver to make sure each passenger under 16 is belted. An officer may not stop a driver for a seat belt violation alone without reasonable cause to believe another motor vehicle law was violated.
How are wrongful death damages decided?
Under A.R.S. § 12-613, the jury gives damages it deems fair and just with reference to the injury resulting from the death to the surviving parties entitled to recover, with regard to the mitigating or aggravating circumstances. The recovery is not subject to the deceased person’s debts unless the action is brought on behalf of the estate.
