California Speed, Damages and Claim Rules Behind a Santa Rosa Car Accident Case

A Santa Rosa car crash claim can involve the driver who caused it, other drivers who shared the fault, and sometimes a public agency. California law sets the time to sue, how pain and suffering is divided among defendants, the standard for safe speed, and what a claim to a public agency must say.

Two Years to File

Code of Civil Procedure § 335.1 requires an action for injury to, or for the death of, an individual caused by the wrongful act or neglect of another to be brought within two years.

How Pain and Suffering Is Divided Among Defendants

Civil Code § 1431.2 makes each defendant’s liability for noneconomic damages, such as pain, suffering, emotional distress and loss of consortium, several only: each defendant pays only the noneconomic damages matching its percentage of fault. Economic damages are defined separately as objectively verifiable monetary losses, such as medical expenses, lost earnings and repair costs. For example, imagine $90,000 in noneconomic damages and a defendant found 30 percent at fault: that defendant’s noneconomic share would be $27,000.

The Basic Speed Law

Vehicle Code § 22350 bars driving on a highway at a speed greater than is reasonable or prudent given the weather, visibility, traffic and the surface and width of the road, and in no event at a speed that endangers persons or property.

What a Claim to a Public Agency Must Contain

Government Code § 910 requires a claim to show the claimant’s name and address, the address for notices, the date, place and circumstances of the occurrence, a general description of the injury or loss, the names of any public employees who caused it if known, and the amount claimed if under $10,000. If the claim exceeds $10,000, no dollar amount is stated, but the claim must say whether it would be a limited civil case. Under § 911.2, a claim for injury or death is due within six months after accrual.

Santa Rosa Car Accident Questions

Can I recover if I was mostly at fault?

Yes, in reduced form. Li v. Yellow Cab Co. (1975) adopted pure comparative negligence, which assesses liability in proportion to fault even when the plaintiff is equally or more at fault. For example, imagine $100,000 in damages and 70 percent of the fault: the recovery would be $30,000.

What if someone was killed and no officer came to the scene?

Vehicle Code § 20004 requires a driver involved in a fatal crash, after meeting the other duties, to report it without delay to the nearest California Highway Patrol office or authorized police authority, with the information § 20003 requires, if no traffic or police officer was at the scene.

Does uninsured motorist coverage apply to a hit-and-run?

Yes, on two conditions. For an unknown owner or operator, Insurance Code § 11580.2 requires that the bodily injury arise from physical contact with the vehicle and that the crash be reported within 24 hours to the city police, or to the sheriff or California Highway Patrol in unincorporated territory, with a statement under oath filed with the insurer within 30 days after that.
