An Augusta motorcycle crash claim can raise Georgia’s helmet and eye protection statute, the written notice rules for a claim against a county or a city, and who recovers the full value of a rider’s life after a fatal crash. Georgia also limits when counsel may argue a dollar figure for pain and suffering.
Helmets and Eye Protection
Under O.C.G.A. 40-6-315(a), no person may operate or ride upon a motorcycle without protective headgear that complies with standards established by the commissioner of public safety, and under (b) a rider on a motorcycle without a windshield must wear an approved eye-protective device. Under (c), the section does not apply to persons riding within an enclosed cab or motorized cart, or to a person operating a three-wheeled motorcycle used only for agricultural purposes.
Claims Against a County or a City
Under O.C.G.A. 36-11-1, all claims against counties must be presented within 12 months after they accrue or become payable, with 12 months after removal of a disability for minors and others under a disability. Under 36-33-5(b) and (e), a claim against a municipal corporation must be presented in writing to its governing authority within six months of the event, with the time, place, extent of injury, negligence and specific amount sought. Which rule governs depends on whether the defendant is a county or a municipal corporation.
When a Rider Dies
Under O.C.G.A. 51-4-2(a), the surviving spouse or, if there is none, the child or children may recover the full value of the life of the decedent, as shown by the evidence. Under (d), the recovery is divided equally among the spouse and children, with the spouse receiving at least one-third, and under (e) it is not subject to any debt of the decedent or the estate.
Arguing a Value for Pain and Suffering
Under O.C.G.A. 9-10-184, as rewritten by SB 68 in 2025, counsel may argue the worth or monetary value of noneconomic damages only after the close of evidence, at the party’s first opportunity to argue damages, and the argument must be rationally related to the evidence; a party with the opening and concluding arguments may not argue a different value in closing than in opening.
Augusta Motorcycle Accident Questions
How long do I have to sue?
Two years after the right of action accrues for injuries to the person under O.C.G.A. 9-3-33, and four years for a loss of consortium claim, except as otherwise provided in that article.
Can I recover if I was partly at fault?
Yes, if you were less than 50 percent responsible. Under O.C.G.A. 51-12-33(a) and (g), damages are reduced by your percentage of fault, and a plaintiff 50 percent or more responsible recovers nothing. For example, imagine $70,000 in damages and 40 percent of the responsibility on the rider: the recovery would be $42,000.
Does my policy include uninsured motorist coverage?
Yes, unless rejected in writing. Under O.C.G.A. 33-7-11(a)(1), a motor vehicle liability policy issued in Georgia must include uninsured motorist coverage, but the requirement does not apply where any insured named in the policy rejects the coverage in writing.
