Helmet and Eye Protection Rules, Shared Fault and Hit-and-Run Penalties for Newark Motorcycle Crashes
A Newark motorcycle crash claim can involve New Jersey’s helmet rule, which covers every operator and rider, and its eye protection rule for operators. New Jersey then compares the rider’s negligence with the other side’s, applies its 60 percent rule to multiple defendants, and penalizes a driver who leaves.
Helmets for Every Operator and Rider
Under N.J.S.A. 39:3-76.7(a), a person may not operate or ride upon a motorcycle without a securely fitted protective helmet of a type approved by the chief administrator, equipped with a neck or chin strap and reflectorized on both sides. Under (b), no motor vehicle points are assessed for failing to wear one.
Goggles or a Face Shield
Under N.J.S.A. 39:3-76.8, no person may operate a motorcycle without goggles or a face shield of an approved type. Both rules exclude a fully enclosed three-wheeled vehicle with a single cab, passenger-type seats, seat belts and automotive steering.
Comparing the Rider’s Negligence
Under N.J.S.A. 2A:15-5.1, contributory negligence does not bar recovery if it was not greater than the negligence of the person against whom recovery is sought, or the combined negligence of the persons against whom recovery is sought, and damages are diminished by the rider’s percentage. New Jersey’s no-fault act is built around the “automobile”: under N.J.S.A. 39:6A-2(a), the term means a private passenger automobile of a passenger or station wagon type and listed pickup, van and camper vehicles, and the definition does not list motorcycles. Ask the insurer and counsel which medical coverage and lawsuit rules reach a rider.
The 60 Percent Rule
Under N.J.S.A. 2A:15-5.3(a) and (c), the rider may recover the full damages from any party found 60 percent or more responsible, and only that party’s own percentage from a party found less than 60 percent responsible. If a city or county vehicle was involved, the claim must first be presented within 90 days after it accrues under N.J.S.A. 59:8-8.
Newark Motorcycle Accident Questions
Do adult riders in New Jersey have to wear a helmet?
Yes. N.J.S.A. 39:3-76.7(a) applies to every person who operates or rides upon a motorcycle, without an age limit.
Can I recover if I was partly at fault?
Yes, if your negligence is not greater than the other driver’s. For example, imagine $85,000 in damages and 20 percent of the negligence on the rider: under N.J.S.A. 2A:15-5.1 the recovery would be $68,000.
What happens to a driver who leaves after hitting a rider?
Under N.J.S.A. 39:4-129(a), a driver knowingly involved in a crash resulting in injury or death who fails to stop, return and remain faces a fine of $2,500 to $5,000, or 180 days imprisonment, or both, and forfeits the license for one year on a first offense.
