The Lawsuit Threshold, Insurance Minimums and the 60 Percent Rule for Newark Car Crashes
A Newark car crash claim in New Jersey can depend on whether the injured person is under the limitation on lawsuit option, which restricts noneconomic damages to listed serious injuries. New Jersey also raised its liability insurance minimums for 2026, makes a defendant 60 percent or more responsible pay the full award, and treats leaving an injury crash as a serious offense.
The Limitation on Lawsuit Option
Under N.J.S.A. 39:6A-8(a), a person subject to the limitation on lawsuit option cannot recover noneconomic loss unless the bodily injury results in death, dismemberment, significant disfigurement or significant scarring, displaced fractures, loss of a fetus, or a permanent injury within a reasonable degree of medical probability, other than scarring or disfigurement.
Liability Insurance Minimums
Under N.J.S.A. 39:6B-1(a), a motor vehicle registered or principally garaged in New Jersey must carry liability coverage of at least $35,000 for injury to one person and $70,000 per accident for plans issued or renewed on or after January 1, 2026, up from $25,000 and $50,000 for plans issued or renewed from January 1, 2023, and $25,000 for property damage.
The 60 Percent Rule
Under N.J.S.A. 2A:15-5.3(a) and (c), the injured person may recover the full amount of the damages from any party found 60 percent or more responsible for the total damages, and only that party’s own percentage from a party found less than 60 percent responsible. Environmental tort actions follow separate rules under (d).
A Driver Who Leaves
Under N.J.S.A. 39:4-129(a), a driver knowingly involved in a crash resulting in injury or death must stop, return and remain at the scene; a violation carries a fine of $2,500 to $5,000, or 180 days imprisonment, or both, with imprisonment only if a person other than the driver was injured or killed, and the license is forfeited for one year on a first offense.
Newark Car Accident Questions
How long do I have to sue after a Newark car crash?
Two years under N.J.S.A. 2A:14-2, except as otherwise provided by law. A claim against a public entity must also be presented within 90 days after it accrues under N.J.S.A. 59:8-8.
Can I recover if I was partly at fault?
Yes, if your negligence is not greater than the negligence of the party you are suing. Under N.J.S.A. 2A:15-5.1, damages are diminished by your percentage. For example, imagine $90,000 in damages and 30 percent of the negligence on the injured driver: the recovery would be $63,000.
Is there a limit on punitive damages in New Jersey?
Yes. Under N.J.S.A. 2A:15-5.14(b), punitive damages may not exceed five times the defendant’s liability for compensatory damages or $350,000, whichever is greater, and under (c) the limit does not apply to listed causes of action, including one against a driver convicted of driving while intoxicated under 39:4-50.
