Truck Maintenance, Hazardous Loads and Government Truck Claims in Henderson Truck Crash Cases
A Henderson truck crash claim can look at the carrier’s federal duties to maintain the truck, insure a hazardous load at the required tier and keep a driver at or above 0.04 alcohol off duty. When the truck belongs to a city, county or the State, Nevada sets a filing rule and a damages limit, and underinsured motorist coverage has a matching provision.
Maintenance and Inspection
Under 49 CFR 396.3, every motor carrier must systematically inspect, repair and maintain each vehicle subject to its control, keep maintenance records for 1 year where the vehicle is housed or maintained, and keep them for 6 months after the vehicle leaves its control. Under 396.17, each commercial motor vehicle, including each unit of a combination, must have passed a periodic inspection within the preceding 12 months.
Hazardous Loads and Alcohol
Under 49 CFR 387.9, listed oil and hazardous materials not covered by the higher rows require $1,000,000 in public liability coverage, and bulk hazardous substances and listed explosive, poison and radioactive categories require $5,000,000. Under 382.201, a driver subject to the federal testing rules may not report for or remain on safety-sensitive duty with an alcohol concentration of 0.04 or greater.
A Government Truck
Under NRS 41.036, a tort claim against the State or its agencies is filed with the Attorney General, and a claim against a political subdivision with its governing body, within 2 years after the cause of action accrues; the filing is not a condition precedent to suing. Under NRS 41.035(1), an award against the State, a political subdivision or a public employee acting within the scope of employment may not exceed $200,000 per claimant, excluding interest from the date of judgment, and may not include punitive damages.
Underinsured Coverage Above the Government Limit
Under NRS 687B.145(2), insurers must offer uninsured and underinsured vehicle coverage equal to the bodily injury limits sold, and when an insured’s actual damages are subject to the NRS 41.035 limit, the underinsured coverage must let the insured recover, up to the insured’s own limits, the actual bodily injury damages that exceed that limit.
Henderson Truck Accident Questions
How long do I have to sue the carrier?
Two years under NRS 11.190(4)(e) for an action to recover damages for injuries to a person or for a death caused by the wrongful act or neglect of another, except as otherwise provided in NRS 11.215 or 11.217.
Can I recover if I was partly at fault?
Yes, if your negligence was not greater than the combined negligence of the defendants, under NRS 41.141. For example, imagine $220,000 in damages and 30 percent of the negligence on the injured driver: the recovery would be $154,000.
Is there a cap on punitive damages?
Yes, with exceptions. Under NRS 42.005(1), punitive damages require clear and convincing evidence of oppression, fraud or malice and may not exceed three times compensatory damages of $100,000 or more, or $300,000 when compensatory damages are less than $100,000; (2) lists actions the limits do not reach. Under NRS 41.035(1), an award against the State, a political subdivision or a public employee may not include punitive damages.
