Helmet Stops, Drunk Driving and Settlement Credits for Plano Motorcycle Crashes
A Plano motorcycle crash claim can raise how the Texas helmet exception works on the road, how an intoxicated driver is treated in the criminal and civil systems, and how settlements with other parties reduce what the rider can still recover.
The Helmet Exception on the Road
Under Texas Transportation Code 661.003(c), the headgear rule does not apply to a person at least 21 who has completed a Chapter 662 motorcycle operator training and safety course or is covered by a health insurance plan with medical benefits for motorcycle collision injuries, and an officer may not arrest or cite a rider 21 or older who presents sufficient evidence of either. Under (c-1), a peace officer may not stop or detain a rider or passenger for the sole purpose of checking the course or the health plan.
A Drunk Driver
Under Texas Penal Code 49.04, operating a motor vehicle in a public place while intoxicated is a Class B misdemeanor with a minimum of 72 hours of confinement, six days with an open container in the driver’s immediate possession, and a Class A misdemeanor with an alcohol concentration of 0.15 or more. Under Civil Practice and Remedies Code 41.008(c), the exemplary damages cap does not apply to conduct described as intoxication assault or intoxication manslaughter.
Shares and Settlements
Under Section 33.003(a), the trier of fact assigns a whole-number percentage of responsibility to each claimant, defendant, settling person and designated responsible third party. Under 33.012(a) and (b), the rider’s damages are reduced by the rider’s own percentage and then by the sum of the dollar amounts of all settlements.
A City Vehicle
Under Section 101.023(c), the liability of a municipality such as the City of Plano is limited to $250,000 per person and $500,000 per occurrence for bodily injury or death, and under 101.101 notice is due within six months after the incident unless a ratified charter period or actual notice applies.
Plano Motorcycle Accident Questions
Can I recover if I was partly at fault?
Yes, unless your percentage of responsibility is greater than 50 percent under Section 33.001. For example, imagine $130,000 in damages and 10 percent of the responsibility on the rider: the recovery would be $117,000.
How long do I have to sue?
Two years after the day the cause of action accrues under Section 16.003(a) for personal injury, and two years after the death under 16.003(b) for wrongful death.
Who brings the claim if a rider is killed?
The surviving spouse, children and parents, or any of them for the benefit of all, under Section 71.004; if none has begun the action within three calendar months after the death, the executor or administrator must bring it unless all of them request otherwise.
