Daily Driving Limits, Driver Files and Fault Shares in Anaheim Truck Crash Claims
An Anaheim truck crash claim can rest on how long the driver had been on duty and whether the carrier should have let that driver drive at all. When the truck driver, the carrier and another motorist share fault, California splits noneconomic damages among them.
The Daily Window
Except as otherwise provided in 49 CFR 395.1, 49 CFR 395.3(a) requires a property-carrying driver to have 10 consecutive hours off duty before driving, limits driving to 11 hours, bars driving after the 14th consecutive hour after coming on duty, and bars driving once 8 hours of driving time have passed without a consecutive 30-minute interruption.
How Long the Records Last
Under 49 CFR 395.8(k)(1), the carrier keeps records of duty status and supporting documents for at least 6 months from receipt. Under 49 CFR 390.15(b), it keeps an accident register for 3 years after each accident, with copies of required accident reports.
Driver Qualification
Except as provided in subpart G, 49 CFR 391.11(b) requires the driver to be at least 21, physically qualified, holding a currently valid commercial license issued by only one jurisdiction, not disqualified, and to have passed a road test or hold a license or certificate the carrier accepted as equivalent, along with the English and experience requirements.
Splitting Noneconomic Damages
Civil Code § 1431.2(a) makes each defendant’s liability for noneconomic damages several only, in direct proportion to that defendant’s percentage of fault, with a separate judgment for that amount.
Anaheim Truck Accident Questions
Can I recover if I was partly at fault?
Yes. Li v. Yellow Cab Co. (1975) adopted pure comparative negligence. For example, imagine $200,000 in damages and 30 percent of the fault on the injured driver: the recovery would be $140,000.
Who may sue when a truck crash is fatal?
Under Code of Civil Procedure § 377.60, the surviving spouse, domestic partner, children and issue of deceased children, or, if there are none, those entitled to the estate by intestate succession; listed dependents may also bring the claim, and the personal representative may assert it on their behalf.
How long do I have to sue?
Two years under Code of Civil Procedure § 335.1 for injury or death caused by another’s wrongful act or neglect. If a city-owned truck was involved, Government Code § 911.2 requires the claim to be presented within six months after accrual.
