Helmets, Insurance Status and Liability Limits in Anaheim Motorcycle Crash Claims

After an Anaheim motorcycle crash, the rider’s own insurance status can limit what the rider may recover, and a statute sets the minimum limits on the other driver’s policy. California’s helmet statute applies to rider and passenger alike.

Helmets

Vehicle Code § 27803 requires the driver and any passenger on a motorcycle, motor-driven cycle or motorized bicycle operated on the highways to wear a safety helmet meeting § 27802, fastened with its straps and of a size that fits securely, and makes it unlawful to operate or ride as a passenger if anyone aboard is not wearing one.

Insurance Status and Noneconomic Losses

Civil Code § 3333.4(a) bars noneconomic losses in a motor vehicle case for an injured person convicted of DUI for that crash, an injured owner whose vehicle was not insured as required, and an injured operator who cannot establish financial responsibility. Under subdivision (c), an uninsured owner injured by a motorist convicted of DUI for that crash keeps the right to recover noneconomic losses.

The Other Driver’s Policy Limits

Vehicle Code § 16056(a)(2) sets, for any policy issued or renewed on or after January 1, 2025, at least $30,000 for injury to or death of one person, $60,000 for two or more people and $15,000 for property damage; earlier policies carried $15,000, $30,000 and $5,000.

More Than One At-Fault Party

Civil Code § 1431.2(a) makes each defendant liable for noneconomic damages only in direct proportion to that defendant’s percentage of fault.

Anaheim Motorcycle Accident Questions

Can I recover if I was partly at fault?

Yes. Li v. Yellow Cab Co. (1975) adopted pure comparative negligence. For example, imagine $80,000 in damages and 35 percent of the fault on the rider: the recovery would be $52,000.

How does the Vehicle Code define lane splitting?

Vehicle Code § 21658.1 defines it as driving a two-wheeled motorcycle between rows of stopped or moving vehicles in the same lane, on divided and undivided streets, roads or highways, and allows the California Highway Patrol to develop educational guidelines.

How long do I have to sue?

Two years under Code of Civil Procedure § 335.1 for injury or death caused by another’s wrongful act or neglect. A claim against a public entity must first be presented within six months after accrual under Government Code § 911.2.
