Statewide Helmet Rules, Public Vehicle Claims and Wrongful Death Actions for St. Louis Motorcycle Crashes

A St. Louis motorcycle crash claim is governed by Missouri’s statewide helmet rule, which no city may expand, and by the state’s waiver of immunity for public employees’ negligent driving. Missouri also sets who may bring a wrongful death action and the penalties for leaving the scene of a crash.

The Helmet Rule and Local Ordinances

Under RSMo 302.020(2), operators and passengers under 26, and operators 26 or older riding with an instruction permit, must wear protective headgear meeting the director’s standards while the motorcycle is moving, and no political subdivision may impose a protective headgear requirement on motorcycle operators or passengers.

A City or State Vehicle

Under RSMo 537.600(1), sovereign immunity is waived for injuries directly resulting from public employees’ negligent operation of motor vehicles in the course of their employment. Under 537.610(2), (3) and (5), the public entity’s liability is limited to $2,000,000 per occurrence and $300,000 per person, adjusted each January 1, with no punitive damages. The Missouri Department of Insurance listed the 2025 adjusted figures as $3,448,710 per occurrence and $517,306 per person; ask counsel which year’s figure applies to the crash.

Who May Bring a Wrongful Death Action

Under RSMo 537.080, the action belongs first to the spouse, children, descendants of deceased children, or parents; if none, to the siblings or their descendants; and if none, to a court-appointed plaintiff ad litem, with only one action against any one defendant for one death.

Leaving the Scene

Under RSMo 577.060, an operator who knows of a crash causing injury, death or property damage and leaves without giving name, residence, vehicle registration or license number and operator’s license number commits a class A misdemeanor, a class E felony if physical injury was caused, and a class D felony if a death resulted.

St. Louis Motorcycle Accident Questions

Can St. Louis require helmets for adult riders?

No. Under RSMo 302.020(2), no political subdivision of Missouri may impose a protective headgear requirement on the operator or passenger of a motorcycle, so the statewide age and permit rules apply.

How long do I have to sue after a St. Louis motorcycle crash?

Five years under RSMo 516.120(4) for an injury claim, and three years under 537.100 for a wrongful death action.

Does a defendant below 51 percent pay the whole judgment?

No. For example, imagine a $120,000 judgment with 45 percent of the fault on one driver and 55 percent on another: under RSMo 537.067 the 45 percent driver is responsible only for $54,000, while the 55 percent driver can be held for the full $120,000.
