Scottsdale Truck Claims: Federal Crash Records and Testing, Arizona Remedies
A truck crash in Scottsdale sets several federal duties in motion for the motor carrier, from testing the driver to recording the crash. Arizona law adds its own duties at the scene and the rules that decide what the injured person recovers.
What Counts as an Accident and What Gets Recorded
49 CFR § 390.5 treats an occurrence involving a commercial motor vehicle on a highway as an accident if it causes a death, an injury treated immediately away from the scene, or disabling damage requiring a tow. For each such accident, § 390.15(b) requires an entry in an accident register kept for three years, and § 390.15(a) requires the carrier to make accident records available to authorized federal, state, local or third-party investigators and to assist the investigation.
Testing the Driver
Under 49 CFR § 382.303, a fatal crash triggers alcohol and drug testing of each surviving driver as soon as practicable; an injury or tow-away crash triggers it when the driver is cited for a moving violation arising from the crash within 8 hours (alcohol) or 32 hours (drugs). If an alcohol test is not given within 2 hours, the carrier must record why, and it stops trying at 8 hours; drug testing efforts stop at 32 hours.
Maintenance Records for Each Vehicle
49 CFR § 396.3(b) requires a carrier to keep, for each vehicle it controls for 30 consecutive days, an identification record, a means of showing the nature and due date of inspection and maintenance tasks, and a record of inspections, repairs and maintenance with their dates.
Arizona Fault and Damages
Under A.R.S. § 12-2505(A), the claimant’s fault reduces the full damages proportionately and does not bar the action, unless the claimant intentionally, wilfully or wantonly caused or contributed to the injury. Article 18, Section 6 of the Arizona Constitution bars any statutory limit on the amount recovered for injuries, apart from its felony-conduct exception.
Scottsdale Truck Accident Questions
Must the truck driver stop if the crash happened in a parking lot?
Yes. A.R.S. § 28-661 applies to the driver of a vehicle involved in an accident on public or private property resulting in injury or death, who must stop and remain until the information and assistance duties in § 28-663 are met.
What deadlines apply in Arizona?
A.R.S. § 12-542 requires a personal injury action within two years after accrual, except as provided in § 12-551. A claim against a public entity or public employee is due within 180 days under § 12-821.01, and the lawsuit within one year under § 12-821.
How are damages decided when the crash was fatal?
A.R.S. § 12-613 directs the jury to award damages it deems fair and just with reference to the injury resulting from the death to the surviving parties, considering mitigating or aggravating circumstances; the recovery is not subject to the deceased person’s debts unless brought on behalf of the estate.
