Road Hazard Claims, Public Entity Deadlines and Helmets in San Bernardino Motorcycle Crashes
A pothole, debris or a defective road surface can bring down a San Bernardino rider with no other vehicle involved. A claim against the public entity responsible for the road has its own liability test, its own required contents and its own deadlines.
The Liability Test
Except as provided by statute, Government Code § 835 makes a public entity liable for injury caused by a dangerous condition of its property if the property was dangerous at the time of injury, the condition proximately caused the injury and created a reasonably foreseeable risk of that kind of injury, and either an employee’s negligent or wrongful act within the scope of employment created it or the entity had actual or constructive notice in time to protect against it.
What the Claim Must Contain
Government Code § 910 requires the claimant’s name and post office address, the address for notices, the date, place and other circumstances of the occurrence, a general description of the injury, the name of the public employee if known, and either the amount claimed if under $10,000 or, above that, whether the claim would be a limited civil case.
The Deadlines
Under Government Code § 911.2, a claim for personal injury is due within six months after accrual. Under § 945.6, suit is due within six months after a written rejection notice is personally delivered or mailed, or within two years from accrual if no notice is given.
Helmets
Vehicle Code § 27803 requires the driver and any passenger on a motorcycle operated on the highways to wear a safety helmet meeting § 27802, fastened with its straps and fitting securely.
San Bernardino Motorcycle Accident Questions
Can I recover if I was partly at fault?
Yes. Li v. Yellow Cab Co. (1975) adopted pure comparative negligence. For example, imagine $100,000 in damages and 30 percent of the fault on the rider: the recovery would be $70,000.
What must a driver who hits a rider do at the scene?
Under Vehicle Code §§ 20001 and 20003, a driver in a crash that injures or kills someone must stop, give name, current residence address, registration number and the owner’s name and address, show a driver’s license on request, and render reasonable assistance to anyone injured.
How long do I have to sue the other driver?
Two years under Code of Civil Procedure § 335.1 for injury or death caused by another’s wrongful act or neglect.
