Underinsured Motorist Coverage, Several Liability and Scene Duties for Reno Car Crashes
A Reno car crash claim can turn on what uninsured and underinsured motorist coverage the insurer had to offer, how damages are divided when more than one driver is at fault, and how a settlement with one of them affects the rest. Nevada also sets the other driver’s duties at the scene and bars use of a seat belt violation in the civil case.
Uninsured and Underinsured Motorist Coverage
Under NRS 687B.145(2), insurers must offer, on an approved form, uninsured and underinsured vehicle coverage equal to the bodily injury limits sold for a passenger car or motorcycle. The coverage lets the insured recover damages that exceed the other driver’s bodily injury limits, up to the insured’s own limits, and the insurer need not reoffer it in a replacement policy, though the insured may request it in writing.
More Than One Driver at Fault
Under NRS 41.141(4), when recovery is allowed against more than one defendant, each is severally liable only for the portion of the judgment matching that defendant’s percentage of negligence, except in the actions listed in (5), such as those based on an intentional tort or concerted acts. Under (3), when a defendant settles before judgment, that defendant’s negligence and the settlement are not put before the jury, and the judge deducts the settlement from the net recovery.
The Other Driver’s Duties at the Scene
Under NRS 484E.010, the driver in a crash on a highway or premises open to the public that injures or kills a person must stop and remain at the scene until meeting the duties in 484E.030; failing to do so is a category B felony with 2 to 20 years in prison and a $2,000 to $5,000 fine. Under 484E.030, the driver must give name, address and registration number, show a license on request, render reasonable assistance and, if no officer is present, report the crash to the nearest office of a police authority or of the Nevada Highway Patrol.
Seat Belts in the Civil Case
Under NRS 484D.495(4)(b), a violation of the seat belt requirement may not be considered as negligence or as causation in any civil action, and under (3) the penalty is a civil penalty of up to $25 or community service.
Reno Car Accident Questions
How long do I have to sue the other driver?
Two years under NRS 11.190(4)(e) for an action to recover damages for injuries to a person or for a death caused by the wrongful act or neglect of another, except as otherwise provided in NRS 11.215 or 11.217. A claim against the city, the county or the State is filed with the governing body or the Attorney General within 2 years under NRS 41.036, and 41.035(1) caps the award at $200,000 per claimant.
Can I recover if I was partly at fault?
Yes, if your negligence was not greater than the negligence of the defendants, under NRS 41.141(1). For example, imagine $58,000 in damages and 25 percent of the negligence on the injured driver: the recovery would be $43,500.
Is there a cap on punitive damages?
Yes, with exceptions. Under NRS 42.005(1), punitive damages require clear and convincing evidence of oppression, fraud or malice and may not exceed three times compensatory damages of $100,000 or more, or $300,000 when compensatory damages are less than $100,000; (2) lists actions the limits do not reach.
