Crash Notice, Property Damage Coverage and Public Entity Claims for Orlando Car Crashes
After an Orlando car crash, Florida law settles who must be notified and how fast, what coverage pays for damaged property, how an unbuckled seat belt affects a claim, and what limits apply when a city, county or state vehicle or road is involved.
Notice to Police
Under Florida Statutes 316.065(1), the driver of a vehicle in a crash causing injury, death or apparent property damage of at least $2,000 must immediately give notice by the quickest means of communication. Inside a municipality such as the City of Orlando, the notice goes to the local police department; outside a municipality, to the county sheriff or the nearest Florida Highway Patrol station.
Property Damage Responsibility
Florida Statutes 324.022(1) requires the owner or operator of a vehicle that must be registered in Florida to maintain the ability to respond in damages of $10,000 for damage to the property of others in any one crash. For injuries, the injured driver’s own personal injury protection pays first under 627.736(1), and pain and suffering against a driver with PIP security is recoverable only for an injury that meets the threshold in 627.737(2), such as a permanent injury or significant and permanent scarring.
Seat Belt Evidence
Under Florida Statutes 316.614(10), a seat belt violation is not negligence per se, is not prima facie evidence of negligence and is not considered in mitigation of damages, but it may be considered as evidence of comparative negligence in a civil action.
Claims Against Public Entities
Florida Statutes 768.28(5)(a) limits recovery against the state, its agencies or subdivisions to $200,000 per person and $300,000 for all claims arising from the same incident, with no punitive damages or prejudgment interest. A judgment above those amounts can be paid only by a further act of the Legislature.
Orlando Car Accident Questions
Can I recover if I was partly at fault?
Yes, unless your share is greater than 50 percent under Florida Statutes 768.81(6). For example, imagine $60,000 in damages and 25 percent of the fault on the injured driver: the recovery would be $45,000.
Does my policy include uninsured motorist coverage?
Yes, if the policy provides bodily injury liability coverage and the coverage was not rejected in writing. Florida Statutes 627.727(1) requires such a policy to include uninsured motorist coverage unless an insured named in the policy makes a written rejection on behalf of all insureds.
How long do I have to sue?
Two years under Florida Statutes 95.11(5)(a) for an action founded on negligence, and two years under 95.11(5)(e) for wrongful death.
