Alabama Traffic Rules and Fault Law Behind a Mobile Car Accident Claim
Because Alabama’s highest court has declined to replace contributory negligence, a Mobile car accident claim can turn on which traffic rule each driver followed. The statutes below set those rules and the deadlines that follow a crash.
Why the Injured Driver’s Conduct Matters
The Alabama Supreme Court, in Golden v. McCurry (1980), declined to replace contributory negligence with comparative negligence, affirming judgment for a defendant where the plaintiff admitted his own contributory negligence. An injured driver’s own conduct is therefore part of the case from the start.
Right-of-Way at Stop and Yield Signs
Ala. Code § 32-5A-112(b) requires a driver at a stop sign to stop at the marked line or before the crosswalk and then yield to any vehicle in the intersection or approaching closely enough to be an immediate hazard. Under subsection (c), a driver at a yield sign must slow to a reasonable speed, stop if safety requires and yield the same way, and a collision in the intersection after driving past a yield sign without stopping is deemed prima facie evidence of failure to yield.
Following Distance
Ala. Code § 32-5A-89(a) bars following another vehicle more closely than is reasonable and prudent, and, except when overtaking and passing, requires at least 20 feet of distance for each 10 miles per hour of speed. At 50 miles per hour, that is at least 100 feet.
Filing Deadline
Ala. Code § 6-2-38(l) sets two years for an action for injury to the person not arising from contract and not specifically listed elsewhere in the section, and § 6-5-410(d) requires a wrongful death action within two years after the death.
Mobile Car Accident Questions
Is there a shorter deadline if a city vehicle caused the crash?
Yes. Ala. Code § 11-47-23 bars a claim against a municipality for damages growing out of a tort unless it is presented within six months from accrual.
Can I move my car after a minor crash?
Yes, if no one appears hurt and the conditions below are met. Under Ala. Code § 32-10-1(b), when a crash involves no apparent injury or death, the driver is not impaired and the vehicle is drivable and can be moved safely, the driver may move it to the shoulder, emergency lane, median or another nearby location and must remain as close to the scene as safely possible. A vehicle in a crash with injury or death may not be moved until a law enforcement officer directs it.
When are punitive damages available in Alabama?
Outside wrongful death actions, Ala. Code § 6-11-20 allows punitive damages in a tort action only where it is proven by clear and convincing evidence that the defendant consciously or deliberately engaged in oppression, fraud, wantonness or malice. The statute defines wantonness as conduct carried on with a reckless or conscious disregard of the rights or safety of others.
What proof of insurance must a driver carry?
Ala. Code § 32-7A-6(a) requires the operator of a covered motor vehicle to carry evidence of insurance in the vehicle, such as an insurance card, the current declarations page, an insurance binder or certificate, or a current rental agreement that specifies coverage.
