Lane Splitting, Following Distance and Policy Limits in Riverside Motorcycle Crashes
A Riverside motorcycle crash in heavy traffic raises two fault questions, where the bike was in the lane and how closely the other vehicle followed, and one money question: what coverage the other driver had to carry.
What the Statute Says About Lane Splitting
Vehicle Code § 21658.1 defines lane splitting as driving a two-wheeled motorcycle between rows of stopped or moving vehicles in the same lane, on divided and undivided streets, roads or highways. It allows the California Highway Patrol to develop educational guidelines in consultation with the DMV, the Department of Transportation, the Office of Traffic Safety and a motorcycle safety organization.
Following Distance
Vehicle Code § 21703 bars following another vehicle more closely than is reasonable and prudent, having due regard for the speed of the vehicles, the traffic and the condition of the roadway.
The Other Driver’s Limits
Vehicle Code § 16056(a)(2) sets, for any policy issued or renewed on or after January 1, 2025, at least $30,000 for injury to or death of one person, $60,000 for two or more people and $15,000 for property damage; earlier policies carried $15,000, $30,000 and $5,000.
At the Scene
Vehicle Code § 20003 requires the driver of any vehicle in a crash resulting in injury or death to give name, current residence address, registration number and the owner’s name and address, to show a driver’s license on request, and to render reasonable assistance to anyone injured.
Riverside Motorcycle Accident Questions
Can I recover if I was partly at fault?
Yes. Li v. Yellow Cab Co. (1975) adopted pure comparative negligence. For example, imagine $75,000 in damages and 20 percent of the fault on the rider: the recovery would be $60,000.
Does the helmet rule apply to adult riders?
Yes. Vehicle Code § 27803 requires the driver and any passenger on a motorcycle operated on the highways to wear a safety helmet meeting § 27802, with no age exception in the section.
How long do I have to sue?
Two years under Code of Civil Procedure § 335.1 for injury or death caused by another’s wrongful act or neglect. A claim against a public entity must first be presented within six months after accrual under Government Code § 911.2.
