Border Carrier Coverage, Driving Limits and Joint Liability in Laredo Truck Crash Claims
A Laredo truck crash can involve a Mexico-domiciled carrier operating in the border commercial zone, and federal rules set how that carrier and every other carrier must keep coverage in force. The driver’s hours that day and the Texas rule on each defendant’s share then shape the claim.
Coverage in the Border Commercial Zone
Under 49 CFR 387.7(b)(3), a Mexico-domiciled motor carrier operating solely in U.S. municipalities on the U.S.-Mexico border or within their commercial zones, with a Certificate of Registration under part 368, may meet the financial responsibility requirements with coverage in the required amounts for periods of 24 hours or longer. Each of its vehicles must carry the Certificate of Registration, the Form MCS-90 endorsement and an insurance document showing the coverage’s effective and expiration dates.
Continuous Coverage
Under 49 CFR 387.7(a) and (b)(1), no motor carrier may operate until the minimum coverage under 387.9 is in effect, and policies and surety bonds remain in effect continuously until terminated, with cancellation requiring 35 days’ written notice. Under 387.9, a for-hire carrier of nonhazardous property in interstate or foreign commerce in a vehicle rated 10,001 pounds or more must carry at least $750,000.
The Daily Driving Window
Except as otherwise provided in 49 CFR 395.1, 49 CFR 395.3(a) requires a property-carrying driver to have 10 consecutive hours off duty before driving, limits driving to 11 hours, bars driving after the 14th consecutive hour after coming on duty, and bars driving once more than 8 hours of driving time have passed without a consecutive 30-minute interruption.
Each Defendant’s Share
Under Texas Civil Practice and Remedies Code 33.013(a), a liable defendant pays only the percentage of damages equal to its percentage of responsibility. Under 33.013(b), a defendant whose percentage is greater than 50 percent is also jointly and severally liable for all of the claimant’s recoverable damages.
Laredo Truck Accident Questions
Can I recover if I was partly at fault?
Yes, unless your percentage of responsibility is greater than 50 percent under Section 33.001. For example, imagine $160,000 in damages and 25 percent of the responsibility on the injured driver: the recovery would be $120,000.
How long do I have to sue the carrier?
Two years after the day the cause of action accrues under Section 16.003(a), and two years after the death under 16.003(b); under 16.001, time while a claimant is younger than 18 or of unsound mind is not counted if the disability existed when the claim accrued. A claim over a City of Laredo truck or a state road condition needs notice first: within six months after the incident under Section 101.101, or a ratified city charter period, unless the unit had actual notice of the injury.
What must the truck driver do at the scene?
Under Texas Transportation Code 550.021 and 550.023, stop, determine whether anyone needs aid, remain at the scene, give name, address, vehicle registration number and liability insurer, show a driver’s license on request and provide reasonable assistance to anyone injured.
