Headgear Rules, Settlement Credits and City Claims for San Antonio Motorcycle Crashes

The Texas headgear statute frames a San Antonio motorcycle claim from the start: helmets are required unless the rider is 21 or older and has completed a safety course or carries qualifying health coverage. Texas law then sets whom to notify after the crash, how responsibility and earlier settlements reduce the rider’s recovery, and the limits on a claim against the city.

The Headgear Rule

Under Texas Transportation Code 661.003(a) and (b), it is an offense to operate or ride as a passenger on a motorcycle on a public street or highway without protective headgear meeting the department’s safety standards, or to carry a passenger without it. Under (c), the rule does not apply to a person at least 21 who has completed a Chapter 662 motorcycle operator training and safety course or is covered by a health insurance plan with medical benefits for motorcycle collision injuries, and under (h) the fine is $10 to $50.

Notice to the Police

Under Section 550.026(a), a collision causing injury, death or damage that leaves a vehicle unable to be normally and safely driven must be reported immediately by the quickest means of communication to the local police department when it occurs in a municipality such as San Antonio.

Shares and Settlements

Under Texas Civil Practice and Remedies Code 33.003(a), the trier of fact assigns a whole-number percentage of responsibility to each claimant, defendant, settling person and designated responsible third party. Under 33.012(a) and (b), the rider’s damages are reduced by the rider’s own percentage and then by the sum of the dollar amounts of all settlements.

A City Vehicle

Under Section 101.021, a governmental unit is liable for injury from an employee’s operation or use of a motor-driven vehicle when the employee would be personally liable. Under 101.023(c), a municipality’s liability is limited to $250,000 per person and $500,000 per occurrence for bodily injury or death, and under 101.101 notice is due within six months unless a ratified charter period or actual notice applies. Under 101.055(2), the chapter does not apply to a city driver’s response to an emergency call or emergency situation that complied with the laws for emergency action or, absent such a law, was not taken with conscious indifference or reckless disregard for others’ safety.

San Antonio Motorcycle Accident Questions

Can I recover if I was partly at fault?

Yes, unless your percentage of responsibility is greater than 50 percent under Section 33.001. For example, imagine $120,000 in damages and 15 percent of the responsibility on the rider: the recovery would be $102,000, before any settlement credit.

How long do I have to sue?

Two years after the day the cause of action accrues under Section 16.003(a); under 16.001, time while a claimant is younger than 18 or of unsound mind is not counted if the disability existed when the claim accrued.

Does my policy cover a driver with no insurance?

Yes, if it is an automobile liability policy and the coverage was not rejected in writing. Under Texas Insurance Code 1952.101, an automobile liability policy covering liability for the use of any motor vehicle must include uninsured or underinsured motorist coverage unless any insured named in the policy rejects it in writing.
