Daily Driving Limits, Driver Files and the Exemplary Damages Cap in Irving Truck Crash Claims

An Irving truck crash claim can turn on how long the driver had been on duty, whether the driver was qualified, and what records the carrier kept. Texas law then caps exemplary damages, with listed exceptions, and decides when one defendant answers for the whole recovery.

The Daily Driving Window

Except as otherwise provided in 49 CFR 395.1, 49 CFR 395.3(a) requires a property-carrying driver to have 10 consecutive hours off duty before driving, limits driving to 11 hours, bars driving after the 14th consecutive hour after coming on duty, and bars driving once more than 8 hours of driving time have passed without a consecutive 30-minute interruption.

Driver Files and Carrier Records

Except as provided in subpart G, 49 CFR 391.11(b) requires a driver to be at least 21, to read and speak English sufficiently, to be able to operate the vehicle safely, to be physically qualified, to hold one currently valid commercial license, not to be disqualified, and to have completed a road test or an accepted equivalent. Under 395.8(k)(1), duty-status records are kept at least 6 months, and under 390.15(b) the accident register is kept for 3 years.

The Exemplary Damages Cap

Under Texas Civil Practice and Remedies Code 41.003, exemplary damages require clear and convincing proof of fraud, malice or gross negligence and a unanimous jury. Section 41.008(b) caps them at the greater of two times economic damages plus noneconomic damages found by the jury up to $750,000, or $200,000; under 41.008(c), the cap does not apply to listed felony conduct, including intoxication assault and intoxication manslaughter.

When One Defendant Pays the Whole Recovery

Under Section 33.013, a liable defendant pays only its own percentage of the damages, unless its percentage of responsibility is greater than 50 percent, in which case it is also jointly and severally liable for all of the claimant’s recoverable damages.

Irving Truck Accident Questions

Can I recover if I was partly at fault?

Yes, unless your percentage of responsibility is greater than 50 percent under Section 33.001. For example, imagine $240,000 in damages and 25 percent of the responsibility on the injured driver: the recovery would be $180,000.

How long do I have to sue the carrier?

Two years after the day the cause of action accrues under Section 16.003(a), and two years after the death under 16.003(b); under 16.001, time while a claimant is younger than 18 or of unsound mind is not counted if the disability existed when the claim accrued. If the truck belonged to the City of Irving or another governmental unit, Section 101.101 entitles the unit to notice within six months after the incident, or within a ratified city charter period, unless it had actual notice of the injury.

Who must be notified after a truck crash in Irving?

The local police department, under Texas Transportation Code 550.026(a), when the collision occurs in a municipality and causes injury, death or damage leaving a vehicle unable to be normally and safely driven.
