Road Conditions, Social Hosts and Public Entity Claims in Glendale Car Crashes
A Glendale crash can involve more than the two drivers: a public entity responsible for the road, or a host who served the at-fault driver. California law sets separate tests for each.
The General Duty of Care
Civil Code § 1714(a) makes everyone responsible for injury caused by a want of ordinary care or skill in the management of their property or person, except so far as the injured person brought the injury on themselves willfully or by a want of ordinary care.
A Dangerous Condition of Public Property
Except as provided by statute, Government Code § 835 makes a public entity liable for injury caused by a dangerous condition of its property if the plaintiff establishes that the property was dangerous at the time of injury, that the condition proximately caused the injury and created a reasonably foreseeable risk of that kind of injury, and either that an employee’s negligent or wrongful act within the scope of employment created the condition, or that the entity had actual or constructive notice in time to protect against it.
Presenting the Claim
Government Code § 911.2 requires a claim for death or personal injury to be presented within six months after accrual. Under § 945.6, suit follows within six months after a written rejection notice is delivered or mailed, or within two years from accrual if that notice is not given.
Social Hosts
Civil Code § 1714(c) bars holding a social host who furnishes alcoholic beverages accountable for injuries resulting from their consumption. Subdivision (d) preserves a claim against a parent, guardian or other adult who knowingly furnishes alcohol at their residence to a person they know, or should have known, is under 21, and the claim may be brought by that person or by someone that person harmed.
Glendale Car Accident Questions
How long do I have to sue the other driver?
Two years under Code of Civil Procedure § 335.1 for injury or death caused by another’s wrongful act or neglect.
Can an uninsured driver recover pain and suffering?
No, not as the owner of an uninsured vehicle, under Civil Code § 3333.4(a)(2), unless subdivision (c) applies: an uninsured owner injured by a motorist convicted of DUI for that crash keeps the right to recover noneconomic losses.
Who may bring a claim when the crash is fatal?
Under Code of Civil Procedure § 377.60, the surviving spouse, domestic partner, children and issue of deceased children, or, if there are none, those entitled to the estate by intestate succession; listed dependents may also bring it, and the personal representative may assert it on their behalf.
