Florida PIP Benefits, the Tort Threshold and Fault Rules for Hialeah Car Crashes
After a Hialeah car crash, Florida’s no-fault statutes decide what the injured driver’s own policy pays first and when a claim for pain and suffering against the other driver can proceed. The fault bar and the two-year deadline then govern the lawsuit.
What PIP Pays
Florida Statutes 627.736(1) provides $10,000 in medical and disability benefits and $5,000 in death benefits. Medical benefits pay 80 percent of reasonable expenses for medically necessary services when initial services and care are received within 14 days after the motor vehicle accident, and reimbursement is limited to $2,500 if a listed provider determines the person did not have an emergency medical condition. Disability benefits pay 60 percent of lost gross income.
The Tort Threshold
Under Florida Statutes 627.737(2), damages for pain, suffering, mental anguish and inconvenience against a motorist with PIP security are recoverable only if the injury consists in whole or in part of significant and permanent loss of an important bodily function, permanent injury within a reasonable degree of medical probability other than scarring or disfigurement, significant and permanent scarring or disfigurement, or death.
The 50 Percent Bar
Under Florida Statutes 768.81(6), a party greater than 50 percent at fault for their own harm may not recover; below that line, 768.81(2) reduces economic and noneconomic damages in proportion. For example, imagine $100,000 in damages and 30 percent of the fault on the injured driver: the recovery would be $70,000.
Two Years to Sue
Florida Statutes 95.11(5)(a) sets two years for an action founded on negligence, and 95.11(5)(e) sets two years for wrongful death. A claim against a public entity instead runs under 768.28, with a written injury claim within 3 years and suit within 4 years.
Hialeah Car Accident Questions
When must a crash be reported?
Immediately, under Florida Statutes 316.065(1), when the crash causes injury or death or property damage of at least $2,000; notice goes to the local police department in a municipality, or otherwise to the sheriff or the nearest Florida Highway Patrol station.
What property damage coverage must a driver carry?
Under Florida Statutes 324.022(1), the owner or operator of a motor vehicle required to be registered in Florida must be able to respond in damages of $10,000 for damage to the property of others in any one crash; a policy with at least $30,000 in combined property damage and bodily injury liability for any one crash also satisfies the section.
Can a bar that served the other driver be sued?
Yes, but only in listed cases. Florida Statutes 768.125 bars liability for serving a person of lawful drinking age, except for willfully and unlawfully serving someone under the lawful drinking age or knowingly serving a person habitually addicted to alcohol.
