Distracted Driving, Passenger Rules and Uninsured Riders in Irvine Motorcycle Crashes
An Irvine motorcycle crash can turn on what the other driver was doing with a phone and how closely that driver followed. On the rider’s side, the passenger’s position and the rider’s own insurance status can affect the claim.
Handheld Phones
Vehicle Code § 23123.5 bars driving while holding and operating a handheld wireless telephone or electronic wireless communications device unless it is designed and configured for voice-operated, hands-free use and used that way. The base fine is $20 for a first offense and $50 for each later offense.
Following Distance
Vehicle Code § 21703 bars following another vehicle more closely than is reasonable and prudent, having due regard for the speed of the vehicles, the traffic and the condition of the roadway.
The Passenger
Vehicle Code § 27800 allows a passenger only on a seat securely fastened behind the driver and equipped with footrests, or in a sidecar designed for passengers, and requires the passenger to keep their feet on the footrests while the motorcycle is moving.
Uninsured Riders
Civil Code § 3333.4(a) bars noneconomic losses for an injured owner whose vehicle was not insured as required, an injured operator who cannot establish financial responsibility, and an injured person convicted of DUI for that crash. Under subdivision (c), an uninsured owner injured by a motorist convicted of DUI for that crash is not barred.
Irvine Motorcycle Accident Questions
Can I recover if I was partly at fault?
Yes. Li v. Yellow Cab Co. (1975) adopted pure comparative negligence. For example, imagine $90,000 in damages and 20 percent of the fault on the rider: the recovery would be $72,000.
How does the Vehicle Code define lane splitting?
Vehicle Code § 21658.1 defines it as driving a two-wheeled motorcycle between rows of stopped or moving vehicles in the same lane, on divided and undivided streets, roads or highways, and allows the California Highway Patrol to develop educational guidelines.
How long do I have to sue?
Two years under Code of Civil Procedure § 335.1 for injury or death caused by another’s wrongful act or neglect. A claim against a public entity must first be presented within six months after accrual under Government Code § 911.2.
