Helmet Rules by Age, Motorcycle Licensing and Uninsured Drivers for Kansas City Motorcycle Crashes

A Kansas City motorcycle crash claim can involve Missouri’s age-based helmet rule, which applies to riders under 26 and to permit holders, and its separate motorcycle license requirement. Missouri also extends uninsured motorist coverage to drivers who leave the scene and divides liability among defendants at the 51 percent line.

Who Must Wear a Helmet

Under RSMo 302.020(2), every person under 26 operating or riding as a passenger on a motorcycle or motortricycle on a highway must wear protective headgear while it is moving, as must a person 26 or older operating with an instruction permit. No person may be stopped, inspected or detained solely to check compliance.

The Motorcycle License

Under RSMo 302.020(1)(2) and (3), a person may not operate a motorcycle on a highway without a license showing that the person passed the motorcycle examination, and an owner may not knowingly let someone without that license or a permit drive the motorcycle.

A Driver Who Leaves or Has No Insurance

Under RSMo 379.203(1), uninsured motorist coverage in at least the 303.030 limits must be included in an auto liability policy on a vehicle registered or principally garaged in Missouri, and it applies when the at-fault driver left before being identified and whether or not there was physical contact.

The 51 Percent Line for Defendants

Under RSMo 537.067, a defendant at 51 percent or more of the fault is jointly and severally liable for the judgment, and a defendant below 51 percent is responsible only for its own percentage, unless it answers for an employee defendant.

Kansas City Motorcycle Accident Questions

Do riders 26 and older have to wear a helmet in Missouri?

No, unless they are operating with an instruction permit. RSMo 302.020(2) requires headgear for every operator and passenger under 26 and for operators 26 or older riding on a permit.

How long do I have to sue after a Kansas City motorcycle crash?

Five years under RSMo 516.120(4) for an injury claim, and three years under 537.100 for a wrongful death action. A claim over a city or state vehicle relies on the RSMo 537.600(1) immunity waiver for public employees’ negligent driving, with liability limits under 537.610 that are adjusted each January 1.

Who pays if two drivers caused the crash?

It depends on each driver’s share. For example, imagine a $180,000 judgment with 55 percent of the fault on one driver and 45 percent on another: under RSMo 537.067 the 55 percent driver can be held for the full $180,000, and the 45 percent driver only for $81,000.
