State Agency Claims, Wrongful Death and Fault Rules for Tallahassee Car Crashes

In Tallahassee, a car crash with a state vehicle runs on Florida’s sovereign immunity statute, which sets its own claim steps and caps. When a crash is fatal, Florida’s wrongful death statutes decide who brings the claim and which losses are recoverable.

A Claim Against the State

Under Florida Statutes 768.28(5)(a), the state and its agencies are liable as a private person would be, without punitive damages or prejudgment interest, up to $200,000 per person and $300,000 per incident absent further legislative act. Under (6)(a), an injury claim goes in writing to the agency and to the Department of Financial Services within 3 years after accrual; under (6)(d), failure to make final disposition within 6 months is deemed a denial; and under (14), suit is due within 4 years.

A Fatal Crash and the State

Under the same section, a wrongful death claim against the state goes to the Department of Financial Services within 2 years after the claim accrues, the deemed-denial period is 90 days, and the suit itself is subject to the 95.11(5) limit.

Who Recovers for a Death

Under Florida Statutes 768.20, the personal representative brings the action for the survivors and the estate. Section 768.21 allows lost support and services, lost companionship and mental pain and suffering for listed relatives, medical and funeral expenses to the survivor who paid them, and listed estate losses.

The Fault Bar

Under Florida Statutes 768.81(6), a party greater than 50 percent at fault for their own harm may not recover. For example, imagine $100,000 in damages and 30 percent of the fault on the injured driver: the recovery would be $70,000.
