Helmet and Eyewear Rules, Passenger Limits and Lane Use for Tulsa Motorcycle Crashes

A Tulsa motorcycle crash claim can involve Oklahoma’s equipment rules, which require a helmet for riders under 18 and a windshield or protective eyewear for every motorcycle. Oklahoma also limits who may carry a passenger, bars passing between lanes of traffic, and compares the rider’s negligence with the other side’s.

Helmets for Riders Under 18

Under 47 O.S. 12-609(B), no person under 18 may operate or ride on a motorcycle unless properly wearing a crash helmet that complies with 49 CFR 571.218.

Windshield or Eyewear

Under 47 O.S. 12-609(A)(2), a motorcycle must have a windshield sufficient to protect the operator from foreign objects, or the operator must wear goggles or protective eyewear meeting ANSI Standard Z87.1 with positive retention, or a protective face shield. The equipment list in (A) does not apply to actual trail rides conducted outside public roads and highways.

Carrying a Passenger

Under 47 O.S. 11-1103(A) and (B), no one under 16 may carry a passenger on a motorcycle on a highway, and an operator 16 or older may carry one only if the motorcycle has a wheel diameter of 12 inches or more and is factory-designed and equipped with a double seat and double foot rests or a sidecar with a separate seat.

Passing Between Lanes

Under 47 O.S. 11-1103(D), no driver of a motorcycle may pass other vehicles between lanes of traffic traveling in the same direction, except the operator of an authorized emergency vehicle.

Tulsa Motorcycle Accident Questions

Does every adult rider in Oklahoma have to wear a helmet?

No. Under 47 O.S. 12-609(B), the helmet requirement applies to riders under 18, while the eye protection rule in (A)(2) applies whenever the motorcycle lacks a sufficient windshield.

Can I recover if I was partly at fault?

Yes, if your negligence is not greater than the other driver’s under 23 O.S. 13. For example, imagine $68,000 in damages and 25 percent of the negligence on the rider: under 23 O.S. 14 the recovery would be $51,000.

How long do I have to sue after a Tulsa motorcycle crash?

Two years under 12 O.S. 95(A)(3) for an injury claim, and two years under 12 O.S. 1053(A) for a wrongful death action. If a city, county or state vehicle was involved, the claim must first be presented within one year under 51 O.S. 156(B).
