Border-Zone Carrier Insurance, Driving Limits and Fault in Chula Vista Truck Crashes

Near the border, a Chula Vista truck crash can involve a Mexico-domiciled carrier operating under a federal insurance exception. The other federal rules on coverage, driving time and testing still apply, and California law decides fault.

Continuous Coverage and the Border-Zone Exception

Under 49 CFR 387.7(b)(1), required insurance and surety bonds stay in effect continuously until terminated, and cancellation takes 35 days’ written notice. Under 387.7(b)(3), a Mexico-domiciled motor carrier operating solely in U.S. municipalities on the U.S.-Mexico border, or within their commercial zones, with a Certificate of Registration may meet the requirements with coverage in the required amounts for periods of 24 hours or longer, and must carry copies of the Certificate of Registration, the MCS-90 endorsement and a document showing the coverage dates in each vehicle.

Daily Driving Limits

Except as otherwise provided in 49 CFR 395.1, 49 CFR 395.3(a) requires a property-carrying driver to have 10 consecutive hours off duty before driving, limits driving to 11 hours, bars driving after the 14th consecutive hour after coming on duty, and bars driving once more than 8 hours of driving time have passed without a consecutive 30-minute interruption.

Post-Crash Testing

Under 49 CFR 382.303, a fatal crash requires alcohol and drug testing of the surviving driver, and an injury or tow-away crash requires it when the commercial driver is cited for a moving violation arising from the crash within 8 hours (alcohol) or 32 hours (drugs). Alcohol testing attempts stop at 8 hours and drug testing attempts at 32 hours.

Splitting Noneconomic Damages

Civil Code § 1431.2(a) makes each defendant’s liability for noneconomic damages several only, in direct proportion to that defendant’s percentage of fault.

Chula Vista Truck Accident Questions

Can I recover if I was mostly at fault?

Yes. Li v. Yellow Cab Co. (1975) adopted pure comparative negligence. For example, imagine $100,000 in damages and 60 percent of the fault on the injured driver: the recovery would be $40,000.

How long do I have to sue?

Two years under Code of Civil Procedure § 335.1 for injury or death caused by another’s wrongful act or neglect.

What if a state or city vehicle was involved?

Government Code § 911.2 requires the claim to be presented within six months after accrual. Under § 945.6, suit is due within six months after a written rejection notice, or two years from accrual if no notice is given.
