Post-Crash Duties, Testing Windows and Weekly Hours in San Diego Truck Crashes

The hours after a San Diego truck crash set off duties under two bodies of law: California’s scene and reporting rules for every driver, and federal testing rules for the motor carrier. The driver’s week before the crash can matter as much as the crash itself.

What Counts as an Accident

Under 49 CFR 390.5, an accident is an occurrence involving a commercial motor vehicle operating on a highway in interstate or intrastate commerce that results in a fatality, an injury for which the person immediately receives treatment away from the scene, or disabling damage requiring a tow. Boarding or alighting from a stationary vehicle and loading or unloading cargo alone are excluded.

Testing Windows

Under 49 CFR 382.303, a fatal crash requires alcohol and drug testing of the surviving driver, and an injury or tow-away crash requires it when the commercial driver is cited for a moving violation arising from the crash within 8 hours (alcohol) or 32 hours (drugs). If the alcohol test is not given within 2 hours, the carrier records why, and attempts stop at 8 hours; drug testing attempts stop at 32 hours. Nothing in the section requires delaying necessary medical attention.

The Driver’s Week

Under 49 CFR 395.3(b), a property-carrying driver may not drive after 60 hours on duty in 7 consecutive days, or 70 hours in 8 consecutive days if the carrier operates every day, and under 395.3(c) any period of 7 or 8 consecutive days may end with 34 or more consecutive hours off duty.

California Scene Duties

Vehicle Code § 20001 requires the driver of any vehicle in a crash that injures or kills a person to stop and fulfill § 20003 and § 20004. Under § 20003, that means giving name, current residence address, injured occupants’ names and addresses, registration number and the owner’s name and address, showing a driver’s license on request, and rendering reasonable assistance to anyone injured.

San Diego Truck Accident Questions

Can I recover if I was partly at fault?

Yes. Li v. Yellow Cab Co. (1975) adopted pure comparative negligence. For example, imagine $200,000 in damages and 35 percent of the fault on the injured driver: the recovery would be $130,000.

What is the difference between economic and noneconomic damages?

Civil Code § 1431.2(b) defines economic damages as objectively verifiable monetary losses, such as medical expenses, loss of earnings and repair costs, and noneconomic damages as subjective, non-monetary losses, such as pain, suffering and emotional distress. Each defendant’s share of noneconomic damages is several only under subdivision (a).

How long do I have to sue?

Two years under Code of Civil Procedure § 335.1 for injury or death caused by another’s wrongful act or neglect. If a government vehicle was involved, Government Code § 911.2 requires the claim to be presented within six months after accrual.
