Carrier Coverage, Driving Limits and Defendant Shares in San Antonio Truck Crash Claims

A San Antonio truck crash claim can draw on federal rules for interstate carriers, including how much coverage the carrier must have and how long the driver may drive. Texas law then decides how responsibility is split among the driver, the carrier and others, and how far exemplary damages can go.

Which Trucks the Federal Rules Reach and Their Coverage

Under 49 CFR 390.5, a commercial motor vehicle includes a vehicle used on a highway in interstate commerce with a gross vehicle weight rating or gross combination weight rating, or actual gross weight, of 10,001 pounds or more, whichever is greater. Under 49 CFR 387.9, a for-hire carrier hauling nonhazardous property in interstate or foreign commerce in a vehicle rated 10,001 pounds or more must carry at least $750,000 in public liability coverage, and under 387.7 it may not operate until that coverage is in effect.

The Daily Driving Window

Except as otherwise provided in 49 CFR 395.1, 49 CFR 395.3(a) requires a property-carrying driver to have 10 consecutive hours off duty before driving, limits driving to 11 hours, bars driving after the 14th consecutive hour after coming on duty, and bars driving once more than 8 hours of driving time have passed without a consecutive 30-minute interruption.

Shares of Responsibility

Under Texas Civil Practice and Remedies Code 33.013(a), a liable defendant pays only the percentage of damages equal to its percentage of responsibility. Under 33.013(b), a defendant found more than 50 percent responsible is also jointly and severally liable for all of the claimant’s recoverable damages.

Exemplary Damages

Under Section 41.003, exemplary damages require clear and convincing proof that the harm resulted from fraud, malice or gross negligence, and a unanimous jury. Section 41.008(b) caps them at the greater of two times economic damages plus noneconomic damages found by the jury up to $750,000, or $200,000, and 41.008(c) lists felony conduct to which the cap does not apply.

San Antonio Truck Accident Questions

Can I recover if I was partly at fault?

Yes, unless your percentage of responsibility is greater than 50 percent under Section 33.001. For example, imagine $150,000 in damages and 30 percent of the responsibility on the injured driver: the recovery would be $105,000.

How long do I have to sue the carrier?

Two years after the day the cause of action accrues under Section 16.003(a) for personal injury, and two years after the death under 16.003(b) for wrongful death. A City of San Antonio truck or a state road condition needs notice sooner: Section 101.101 sets six months after the incident, or a ratified city charter period, unless the governmental unit had actual notice of the injury.

Who brings the claim when a truck crash is fatal?

The surviving spouse, children and parents, or any of them for the benefit of all, under Section 71.004; if none has begun the action within three calendar months after the death, the executor or administrator must bring it unless all of them request otherwise.
